This request is for information on any complaints or correspondence that Transport for London has received about the behaviour or performance of Jonathan Owen in his role as the manager of the Seven Sisters Indoor Market in Tottenham.

Since 1st January 2015 to date, has TFL received any formal complaints about the behaviour or performance of Jonathan Owen in his role as the manager of the Seven Sisters indoor market?

Since 1st January 2015 to date, has anybody raised with TfL their concerns about the behaviour or performance of Jonathan Owen in his role as the manager of the Seven Sisters indoor market?

In answering the above two questions please provide the correspondence received and any actions taken by TfL. If it is necessary to redact the name of those complaining or raising their concerns then that is perfectly acceptable.

Thank you for your request received by Transport for London (TfL) on 9
November 2017 asking for information about complaints received in relation
to Seven Sisters indoor market.

 

Your request has been considered under the requirements of the Freedom of
Information Act 2000 and our information access policy.

 

However, as your request relates purely to an individual, who you have
named as Jonathan Owen, we are unable to provide you with any of the
information requested, due to our  obligations under the Data Protection
Act 1998 (DPA), and as required by section 40(2) of the FOI Act. We are
also unable to confirm or deny whether we hold any of the information you
have requested.

 

This is because information relating to an identifiable individual is
personal data, and releasing anything which may be held would be a breach
of the DPA, specifically the first principle of the DPA which requires all
processing of personal data to be fair and lawful. It would not be fair to
disclose this personal information when the individuals have no
expectation it would be disclosed and TfL has not satisfied one of the
conditions of Schedule 2 of the Data Protection Act which would make the
processing ‘fair’.

Thank you for your request received by Transport for London (TfL) on 7
January 2018 asking for information about the management of the Seven
Sisters indoor market.

 

Your request has been considered under the requirements of the Freedom of
Information Act 2000 and our information access policy.

 

I can confirm that we do hold the information you require. However, to
provide the information you have requested would exceed the ‘appropriate
limit’ of £450 set by the Freedom of Information (Appropriate Limit and
Fees) Regulations 2004.

 

Under section 12 of the FOI Act, we are not obliged to comply with
requests if we estimate that the cost of determining whether we hold the
information, locating and retrieving it and extracting it from other
information would exceed the appropriate limit. In this instance, we
estimate that the time required to answer your request would exceed 18
hours which, at £25 per hour (the rate stipulated by the Regulations),
exceeds the ‘appropriate limit’.

 

There is a large volume of correspondence and documents held due to the
various nature of our involvement with the market site. All individual
records dating back to the beginning of 2015 would need to be identified,
retrieved and manually checked to see if they are relevant to your
request. Many of the records are held only in paper format and held in
archives. For more recent correspondence, the electronic records of
everyone involved with the market would need to be searched for documents
relating to Seven Sisters indoor market, which would also need to be
manually checked. Therefore searching for relevant information would
easily exceed the appropriate limit.

 

To help bring the cost of responding to your requests within the £450
limit, you may wish to consider refining your requests to concentrate on
matters which are particularly important to you, or you may wish to refine
your request to cover a shorter time frame. Although your request can take
the form of a question, rather than a request for specific documents, TfL
does not have to answer your question if it would require the creation of
new information or the provision of a judgement, explanation, advice or
opinion that was not already recorded at the time of your request. If you
have specific questions relating to these topics we may be more easily
able to respond to these than to a request for any information held.

 

If you do wish to make a refined request, I think it would be helpful for
me to clarify the relationship between TfL, MAM and the market traders. We
lease the premises to MAM for uses that could include retail, café,
residential and car parking. We have not appointed MAM as a market
facilitator and as a result have no direct relationship with traders. This
distinction means that TfL does not  influence the day-to-day running of
the market, or to intervene in licence disputes.
