Has Councillor Larkin Voted In Contravention Of s106 Local Government Finance Act 1992?

Dear Worth Parish Council,

In a document filed at Horsham County Court in case 9QT56781 Mr Michael John Forrest -v- Village Interiors, Councillor Larkin has stated that he has council tax arrears of £330.

Has Councillor Larkin complied fully with the requirements of s106 Local Government Finance Act 1992? Has Councillor Larkin participated in any votes in contravention of the provisions of this section of the Act?

Exactly how much in arrears was Councillor Larkin on 18 July 2013 when he filed the document at Horsham County Court and for how long had he been in arrears?

Many thanks for your email and subsequent hard-copy letter sent to Dave Blackman (Chairman) with a copy to myself.

I note that at the same time you have made a formal complaint to Tom Clark, Mid Sussex District Council on the same matter. That complaint must take precedence and so will need to be considered by MSDC first.

Therefore I need to say that Worth Parish Council should not respond to your request until such time that the complaint has been dealt with under the MSDC Complaints procedure.

In papers submitted to Horsham County Court, Councillor Larkin declared that he was in arrears with his Council Tax payments. This question was deferred while another matter was addressed by the Standards Committee. That matter has now been resolved.

By how much has Councillor Larkin been in arrears, and is he still in arrears? Has he participated in any council votes while being in arrears, and if so, by how much was he in arrears at that time? If he is no longer in arrears, on what date did he clear those arrears?

Thank you for your email.

Council Tax is collected by Mid Sussex District Council and therefore whether a resident was in arrears would not usually be disclosed to the Parish Council. Given your request, it would be for Mid Sussex District Council to say whether they can disclose such information; if so, whether Cllr Larkin was in arrears and then for what period. Thereafter I would be in a position to check attendance records at Worth Parish Council meetings for that period.

I have copied Tom Clark into this email so that your request for Council Tax payment records can be considered. I shall reply to you once I have heard back from Mid Sussex District Council.

There is no requirement to provide the Council Tax payment records, provided Councillor Larkin provides the information requested, vis "Exactly how much in arrears was Councillor Larkin on 18 July 2013 when he filed the document at Horsham County Court and for how long had he been in arrears?" At any time, did the amount of his arrears exceed the threshold at which he was legally forbidden to vote in council matters?
