Haringey Council's extortion racket abetted by police, courts and bailiffs – 'Operation Stop It'

Dear Haringey Borough Council,

Published in the Daily Mail, 2nd February 2013, it was reported
that a £200 penalty was extorted from a driver of a vehicle for not
displaying a "No smoking sign". This operation is run by Haringey
Council, police and bailiffs, and called 'Operation Stop It'

Statutory Instruments are created and amended for the purpose of
removing peoples rights, and it seems Haringey Council are taking
advantage of this by applying them as a means of extorting money
from its residents through the courts.

Since the introduction of 'Operation Stop It';

1) How many fines have been issued and to what value

2) How many £200 fines have been issued for not displaying 'no
smoking signs' in company vehicles

3) How much is a £200 fine for not displaying 'no smoking signs' in
a company vehicle (presumably a code 2 offence) reduced to if paid
within 14/15 days from the day of the offence.

4) How much is a £200 fine for not displaying 'no smoking signs' in
company vehicle increased to if not paid within a 28/29 day period.

5) What subsequent action is Haringey council permitted to take
should the penalty not be settled within the 28/29 day period, and
what schedule of fees are bailiffs permitted to apply if that is
the action taken.

6) Which Act of Parliament/Secondary legislation is applicable for
enforcing this and when was it created or amended for this purpose.

Thank you for your request for information received on 5 February 2013, in which you asked for the following information:

1) How many fines have been issued and to what value

2) How many £200 fines have been issued for not displaying 'no
smoking signs' in company vehicles

3) How much is a £200 fine for not displaying 'no smoking signs' in
a company vehicle (presumably a code 2 offence) reduced to if paid
within 14/15 days from the day of the offence.

4) How much is a £200 fine for not displaying 'no smoking signs' in
company vehicle increased to if not paid within a 28/29 day period.

5) What subsequent action is Haringey council permitted to take
should the penalty not be settled within the 28/29 day period, and
what schedule of fees are bailiffs permitted to apply if that is
the action taken.

6) Which Act of Parliament/Secondary legislation is applicable for
enforcing this and when was it created or amended for this purpose.

My response is as follows:

1) Since 2009, 190 fixed penalty notices have been issued to the value of £ 17,950.00

2) 190

3) £150

4) It is not increased

5) The Council is permitted to refer the matter for prosecution for the original offence. The maximum fine a court can impose is £1000. I cannot comment on the schedule of bailiff fees, as this is something that is in the remit of the courts.
