Handling of Subject Access Requests sent to Capita
Dear Department for Work and Pensions,
Please provider the clauses of your contract with Capita as to what Capita and the DWP should do if a data subject sends a subject access request to Capita instead of direct to the DWP.
I know that the DWP is the data controller and Capita the data processor, so it is the DWP who should deal with SARs. But given there will be substantial interaction between Capita and claimants, it is understandable that claimants may send SARs to Capita.
I want to know what your contract with Capita says about what Capita should do with such SARs.

This is dealt with in the file Service Specification FINAL V2.0. Section 22.7 states:
22.7. The Contractor will forward all enquiries to the Authority within two working days. The Contractor will provide any requested and appropriate information to assist the Authority in replying, to an agreed deadline provided by the Authority on a case by case basis. This includes but is not limited to:
- Official correspondence;
- Ministerial correspondence;
- Ministerial briefing;
-Parliamentary questions;
- Press enquiries;
- Freedom of Information requests;
- Subject Access requests.
Annex 7 Service Level Agreements also includes it in SLA 12 on page 6.
