Where these records include copies of the actual information that was the subject of the original request, this may be removed if you wish, but please replace it with an indication that the information was present.

Dear Cabinet Office,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Cabinet Office's handling of my FOI request 'handling of previous FOI request'.

You have not given any significant explanation of why this request might be vexatious and your refusal notice is therefore inadequate. I note that you have section 12 available to you if my request really did impose a substantial burden on the Cabinet Office, unless you can demonstrate that is burdensome when set within its "wider context" (as per the ICO guidance). My request does have an obvious serious purpose, namely to gain an understanding of the failures inside your department that led to such a huge breach of the law during the handling of the original request I referred to.

Also I wish to complain that your response was not prompt given its brief content. It gives rise to the suspicion that you have delayed the maximum amount of time in order to spin this request out.

Dear Cabinet Office,

On 19th July 2011, the Information Commissioner issued a decision notice (ref FS50366824) in which he ordered you to confirm or deny whether you held the information I requested and if held, to either provide it or issue a valid refusal notice. The time limit for this was 35 calendar days, which expired on 23rd August without you taking the required steps, and as far as I can ascertain from the Information Tribunal's current case list of 25th August, no appeal has been made either.

Please advise immediately what the situation with this request is. I will also be contacting the Commissioner.
