Dear Hampshire County Council,

I would like to make a request under the FOI Act.

For the purposes of the Act, please take the date of your receipt of this request as 11th July 2017.

I am interested in the relationship (if any) between your organisation and the Hampshire Health Record (clinical data repository).

In a previous FOI response, you indicated that you were planning to extract and upload personal confidential information from your databases to the HHR database.

• Please could you tell me whether your organisation has now commenced extracting and uploading personal confidential data about patients/clients to the HHR?

• If not commenced already, do you have plans to commence feeds into the HHR at anytime between now and 31st March 2018?

If the answer to both of the above is no, then thank you very much, ignore the remainder of this request, and please consider my request closed.

However, if your organisation has already commenced uploading, or is planning to before March 31st 2018, then please can you provide me with the following information:

• Has Hampshire County Council opted out of making its uploaded data to the HHR available for secondary uses, such as the analytics database (HHRA) which is used for research and population health?

i) If not (and you do permit it), whether you obtain freely given, specific, informed and unambiguous explicit consent from clients, by means of a clear affirmative action, before permitting such secondary uses of personal confidential information by the organisation that you are uploading information to (the HHR)?

ii) If not (and you do permit it), the process by which clients may express an objection - to you (the data controller) - to secondary uses of their uploaded information by the HHR (HHRA), whilst still permitting the use of that uploaded information for direct medical care (the primary purpose)

• The opt-out form (or process) available to patients to express complete dissent - to you (the data controller) - to this type of processing of their data, and so completely block uploading of all their personal confidential data to the HHR by HCC

I would be grateful if you would be kind enough to send me the requested information promptly and in any event not later than the twentieth working day following the date of receipt of my request.

I would be grateful if you would kindly acknowledge receipt of this request as recommended by the ICO (“It would be good practice to acknowledge receipt of requests and to refer to the 20 working day time limit, so that applicants know their request is being dealt with”).
