Dear Southern Health NHS Foundation Trust,
I would like to make a request under the FOI Act.
For the purposes of the Act, please take the date of your receipt of this request as 3rd February 2016.
I am interested in the relationship (if any) between your organisation and the Hampshire Health Record (clinical data repository).
• Please could you tell me whether your organisation has commenced extracting and uploading personal confidential hospital data about patients to the HHR?
• If not commenced already, do you have plans to commence feeds into the HHR at anytime between now and 31st March 2017?
If the answer to both of the above is no, then thank you very much, ignore the remainder of this request, and please consider my request closed.
However, if your organisation has already commenced uploading, or is planning to before March 31st 2017, then please can you provide me with the following:
• Any and all fair processing information (posters/leaflets/handouts) made available, or planning to be made available, to patients informing them of this new use of their data
• Any and all policies on the implementation of HHR feeds by your organisation
• The types of information that you will be extracting and uploading to the HHR
• The opt-out form (or process) available to patients to express dissent to this type of processing of their data, and so block uploading of their personal confidential data to the HHR by your organisation (in line with the DPA and NHS Constitution)
I would be grateful if you would be kind enough to send me the requested information promptly and in any event not later than the twentieth working day following the date of receipt of my request.
I would be grateful if you would kindly acknowledge receipt of this request as recommended by the ICO (“It would be good practice to acknowledge receipt of requests and to refer to the 20 working day time limit, so that applicants know

Thank you for your response.
I don't think you have answered my final question, or provided me with the information that I requested.
I appreciate that patients can dissent from the HHR at their GP practice, or by contacting the HHR office directly as per your link.
I also appreciate that you have a system on OpenRio whereby dissent to the sending of information to the HHR can be recorded, therefore "turning off the feed from RIO to the HHR" for that individual's record.
However, such dissent can only be activated by you *if and when* you know that the patient has dissented.
If you are not aware that the patient has dissented from the HHR, then you cannot turn of their OpenRio feed, obviously.
Accordingly, could you either:
1) Confirm that NHS SCWCSU informs you, and indeed has informed you, of each patient who has dissented from from the HHR, so enabling you to turn off the OpenRio feed for those patients ; or
2) Provide me, as I originally asked for in my FOI request, with the form that patients must use, or process that patients must follow, to inform you (Southern Health, *directly* , that they wish the OpenRio feed to the HHR to be switched off for their Southern Health record (that is, in addition to dissenting at their GP practice)
If you are happy to respond to this quickly, great, otherwise please inform me if you are taking this message as a request for an internal review. Alternatively, I can refer the matter to the ICO, as you prefer.

Please find below our response to your requests for clarification:
Accordingly, could you either:
1) Confirm that NHS SCWCSU informs you, and indeed has informed you, of
each patient who has dissented from from the HHR, so enabling you to turn
off the OpenRio feed for those patients
The process is automatic. The patient record must already exist in the
HHR for the Trust to be able to send any data. Absence of a record in the
HHR essentially causes any record SHFT might try to send to be ignored due
to a lack of prior consent given to the GP. This is because it is the GP
feed that causes the initial record creation in the HHR. SHFT data sent
to the HHR cannot be used to establish a patient record, they will only
add to existing records.
When SHFT prepares the data file to be sent to the HHR a filter takes out
any records for patients that have not given their consent for SHFT to
share the data with the HHR, regardless of whether there is already a
record shared by the GP. i.e. the patient could in essence allow GPs to
share their records, but restrict SHFT from sharing their records.
When a patient removes consent, and where SHFT may have already sent
previous records for that same patient to the HHR, a blank record is sent
to the HHR. This causes any SHFT records in the HHR to be removed for that
patient.
2) Provide me, as I originally asked for in my FOI request, with the form
that patients must use, or process that patients must follow, to inform
you (Southern Health, *directly* , that they wish the OpenRio feed to the
HHR to be switched off for their Southern Health record (that is, in
addition to dissenting at their GP practice)
There is no separate paper form, the information is recorded in the
electronic patient record on an electronic form, which the clinician
completes – as per the screenshot previously disclosed.
Once again, please accept my apologies that our initial response did not
cover all the requested information. If you have any further questions
