Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of NHS Blood and Transplant's handling of my FOI request 'Haem Search'.
I believe S32 has been applied erroneously. S32 is applicable where information is held "only" by virtue of being contained any document placed in the custody of a person conducting an inquiry. I do not believe the information requested is held "only" by this virtue and therefore S32 is not applicable. Furthermore, s. 32 may not be engaged by virtue of s.63 of the FOI Act (i.e. historical records) which specifies that none of these exemptions may be applied to information contained in a ‘historical record’.
