Guidelines For USE OF AMENITIES IN JOBCENTRE PLUS:

Dear Department for Work and Pensions,

Please answer all the following questions in as much detail as possible in easy to understand terms and if possible avoid referring me to loads of difficult to understand legal links:

Despite multiple requests for the following information especially in writing from multiple managers and work coaches, I have permanently been denied this and no legitimate reasons have been given.

No information exists anywhere in the building to state a claimant has to ‘sign in’ or sign ANYTHING prior to the use of claimant computers.

No information exists anywhere in the building to state a claimant is not permitted to use the printer.

What guidelines state a claimant is not allowed to use a public computer in JCP for job search?

What guidelines state a claimant can suddenly be told they are not permitted to use the computers anymore without providing a legitimate reason?

What guidelines state a claimant can suddenly be told they are not permitted to use the computers anymore without providing evidence for the reason?

If a claimant has no computer, internet access or printer at home this sabotages the claimant’s job search long-term and puts them at high risk of sanction.

Confirm, if the claimant has it written in to their Claimant Commitment they have the right to access the computer facilities to undertake their job search specifically at JCP. If no reason is given, this is a serious breach of the claimant’s contract?

What guidelines state ‘verbal notification’ is insufficient especially when no reason is given?

If JCP demands a Claimant to undertake a specific action they must have a have a legitimate reason that supports the claimant to find work and must be in writing in the form of a Direction.

On what grounds can a claimant be issued a Direction if they refuse to ‘sign in’ to use the facilities?

This raises serious privacy and consent under duress concerns and in breach of the DPA especially as claimant’s regularly print sensitive personal data for example numerous CVs, covering letters, job applications etc.

What guidelines state ‘Data protection legislation is in place so you are not authorised to adjust the printer or collect your prints from the printer so you must ask a member of staff to retrieve any prints you produce.’

Specify what ‘Data protection legislation’ in place?

What guidelines state it is necessary to retain a copy of the letter given to the claimant demanding these actions for future reference on the claimant’s file without any evidence or legitimate reason to support these demands?

No information exists anywhere in the building to state the reason a claimant has to ‘sign in’ is SPECIFICALLY for health and safety reasons.

There are no health and safety requirements or information anywhere in the building.

For the fact you don’t sign in on attendance at the job centre, why is a claimant suddenly ‘verbally notified’ on another occasion they have to ‘sign in’ to use the computers for health and safety reasons?

What guidelines state a customer is MANDATED to sign a book containing separate blank lined sheets down each page with the date scrawled at the top of the page prior to use despite the book is always placed on a different desk to one with the PCs?

What guidelines state if the claimant is told they ‘HAVE’ to sign the book prior to use they are legally entitled to know why?

If so, on what grounds does JCP have the right to threaten the claimant with security if they refuse?

On what grounds does JCP have the right to threaten the claimant with the police if they refuse?

If the claimant refuses to sign and continues to use the PCs, what is the correct procedure JCP must follow?

If the customer only has access to computers in the public library and Jobcentre, this is sabotage of their job search and unlawful?

On what grounds can a customer be issued with a Direction for refusing to ‘sign in’ whilst diligently using the PCs to undertake copious job search in the knowledge the claimant more than fulfills all the requirements of their Claimant Commitment but is repeatedly subjected to repeat harassment and duress to ‘sign in’ despite doing what they are supposed to do?

On this basis, on what grounds can a claimant be issued a Direction ‘they must also show their job search in a particular way’ in the knowledge the claimant always provides a satisfactory job search?

If this was a legitimate request, information would be readily available to the claimant

On what grounds can a claimant be given a sanction for refusing to ‘sign in’ prior to using the PCs?

On what grounds can the letter issued to the claimant be retained on their file for future reference for refusing to ‘sign in?’

This is a serious breach of the Data Protection Act 1998 as DWP have failed to inform the claimant the legal basis for their requests, why they have retained this information, what they intend to do with it and how long they will retain it

Where does it state unless the claimant fully complies with JCP’s demands at all times despite no wrongdoing, they will be repeatedly threatened with security and the police and thrown out of the building?

Where does it state there is a daily time limit allocated to each claimant to use the pc especially when there is an adequate amount on two floors?

Where does it state a claimant is not allowed to fill the paper tray when empty, especially when it saves bothering someone to do it for you and the claimant is perfectly able to do it themselves?

Where does it state security are allowed to stand beside the printer in the knowledge a claimant has just printed a document/s containing personal and sensitive data and hand it to them face up?

Where does it state security are allowed to stand beside the printer in the knowledge a claimant has just printed several documents containing personal and sensitive data and hand it to them face up having read the top page?

If so, these are breaches of the DPA so please explain why security are allowed to do this?

Where does it state security are allowed to read claimant’s computer screens when wandering about despite containing personal and sensitive data?

This is NOT a personal request as it applies to the public

The reason I have requested this information is it raises serious concerns as JCP have long-term failed to act with transparency over this matter

JCP is demanding EVERYONE who wants to use a PC for job search or make a new claim MUST sign an unofficial ‘signing in sheet’ prior to using a PC

Under the Data Protection Act 1998, JCP have a duty to inform the claimant why they want their personal data, what they intend to do with it and how long they intend to keep it

Yet, JCP repeatedly fail to provide legitimate reasons for retention of this personal data and anyone who challenges this ‘process’ is harassed or asked to leave the building

This is in breach of the Data Protection Act 1998 and a matter of public interest

Therefore, please answer as many questions as possible.
