Guidance/ Procedure for dealing with EEA4 Applications over 6 months old

Dear UK Border Agency,

I am writing to request the following information under the FOI Act:

1. A copy of the Manual/ Guidance document that explains how your case workers are expected to deal with an overdue EEA4 application i.e. when the UKBA does not issue the Residence Card within 6 months as per section 20 of the European Directive 2004/38/EC and the UKBA's Border Force Operation Manual.

In the absence of a manual/ written procedure, I request information on how these cases have been dealt with in the past 12 months, particularly:
- how many applications were not processed within the 6 month time frame;
-the reasons why the applications were not processed within the appropriate time frame;
- how long in total it took for these applications to be processed;

2. A copy of UKBA's internal communications or other relevant documents that show what is being done to resolve the issue of the agency's failure to comply with the EU Directive mentioned above, as well as a time frame for when the UKBA is expected to comply with the regulation.
