Dear Department of Health and Social Care,

My request relates to the NHS Pension Scheme and the guidance used to forfeit pensions as a consequence of criminal activity. A recent case ('R (on the application of the BMA) v. SoS for Health and Social Care', 2020) states that:

"2. Prior to the relevant amendments, the Defendant ("the Secretary of State") had the power to forfeit a pension after a member or beneficiary of the pension scheme had been convicted of a prescribed criminal offence which was committed before the benefit became payable..."

Please provide all current guidance relating to decisions to forfeit convicts' pensions.
