I am writing to request information from the Chief Constable of Strathclyde Police pursuant to the provisions of the Freedom of Information (Scotland) Act 2002. The information I request relates to guidance issued to police officers.

I seek from Strathclyde Police the content of any documents issued to Police Officers which are designed to provide guidance on or instruction as to the investigation or management of the following:

(a) Sexual Offences
(b) Missing persons
(c) public order offences

Of particular interest is the content of any documents produced or issued by ACPOS.

Should it be estimated that the cost of compliance with this information request would exceed the appropriate limit then I would be grateful if you could provide details as to what, if anything, Strathclyde Police believe could be provided within the appropriate limit. Should the is situation arise I would be more than happy to discuss it further in order that a way forward can be established.

Should it be determined that further clarification is required then please do not hesitate to contact me and I will endeavour to provide such clarification as is necessary.

I write regarding the FOI request assigned the above noted reference number and with reference to your E-mail of 17 December 2012.

In your correspondence of 17 December 2012 you stated that you were still considering three documents for disclosure which fell within the scope of my request. I understand that sometimes it is not possible to consider information for release within the required statutory timescale, although the Act does not have any provision for such a delay. I wondered if you would be able to provide an estimation as to when you will have considered whether the outstanding information can be withheld or should be released.

I am awaiting information relating to the Sexual Offences Investigation
SOP. I will hopefully have this tomorrow. Sorry it has taken so long.
Normally an FOI version of SOPS are created in order for publication,
however, this has not been done due to new SOPS being created for the
creation of the new Force. Therefore, I have had to send each document
to the owning departments for assessment.

I just wished to keep you updated to ensure you that the request is
being dealt with.

I am writing with reference to the above noted information request made to Strathclyde Police on 17 November 2012.

Strathclyde Police have been in regular contact with me throughout this time and have disclosed some of the information that falls within the scope of the request. However, the latest update provided by Strathclyde Police on 11 January 2013 stated that some information was still being assessed for disclosure and I have not yet recieved a full response to the request for information.

I appreciate the Strathclyde Police have been in regular contact providing updates and releasing information when they have been able to do so. However, I feel that it has now reached a point where I must ask that Strathclyde Police conducts an internal review into its handling of this information request.

I calculate that it has now been 42 working days since the information request was recieved by Strathclyde Police. This is more than twice the maximum time permitted by s.10(1) of FOISA. This is a considerable delay by Strathclyde Police.

I look forward to recieving Strathclyde Police's repsonse to this requirement for review.

However, I have now attached the response in relation to the Public
Order SOP. As I explained previously, the Force do not hold FOI
versions of these SOPS and I have required to go through each document
and redact information. This type of request will become considerably
less complex with the inception of the new force.

I appreciate the substantial delay has been exasperating, however, I am
sure you can understand that your request has been complex and the most
recent response, attached, required me to compare the SOP to 150 page
document, therefore, I am sure you are aware that your request has not
been delayed intentionally.

I am awaiting information relating to the final SOP - Sexual Offences,
however, I have chased this up and should have a response to you by
close of play on Friday.

I hope this will negate the requirement for review.
