In reply to your request for information under the Freedom of Information
Act 2000, received 11/04/16.

 

The Freedom of Information Act 2000 (The Act) requires us to handle all
requests in a manner that is blind to the identity of the requestor.  Any
information released in response to a request is regarded as being
published, and therefore in the public domain without caveat.

 

Request

 

Please release the "public guidance and advice document which gives
practical advice about various matters including an age limit applied to
attendance, facilities at the venue and the use of mobile phones" relating
to public misconduct hearings referred to at

We have completed all searches within Cambridgeshire Constabulary and
hereby enclose your response.

 

Response

 

Each notice is bespoke to the case in question and is published in the
internet in advance of a public hearing. There, as yet, have not been any
in Cambridgeshire. I have attached a blank example one.

 

The Chair of each hearing has to consider the below in respect of public
hearings and may also set additional conditions which would be included on
the notice.

 

Part 2 Conditions imposed on attendance in order to facilitate the proper
conduct of proceedings.

 

The hearing should not be delayed solely in order to facilitate a
complainant, interested person, or any other member of the public
attending the hearing, although consideration will need to be given to
whether a complainant or interested person is also a witness in the matter
under consideration.

 

Members of the public attending a hearing are expected to do so at their
own expense, except where they are attending as a witness. The appropriate
authority should meet the reasonable expenses of any witnesses.

 

It will normally be appropriate for the person chairing or conducting the
hearing to prohibit the taking of photographs and the use of film or sound
recording equipment during the hearing, except for official use. The use
of live, text-based communications for the purposes of simultaneous
reporting of proceedings may be permitted if the person chairing or
conducting the proceedings is satisfied that it does not interfere with
the orderly conduct of proceedings.

 

At my discretion a hearing can be live streamed by the appropriate
authority to a facility accessible to the public as an alternative to in
person attendance where it would otherwise not be possible to allow public
access to the hearing room or to allow for more people to view the hearing
than can be accommodated.

 

In the case that more people wish to attend the hearing than can be
accommodated, priority will be given to the complainant, any interested
person, and, where appropriate, anyone acting as an observer on behalf of
the IPCC.

 

I may also decide to impose other conditions in advance of, or during, a
hearing.

 

If you are unhappy with this response, please see the attachment, which
sets out your rights to appeal.
