Dear Department for Transport,

On 18 July, the Minister of State for Transport, Jo Johnson, stated that the Department had started conducting a "hard review" of the GTR franchise from 21 June, and that said review was expected to be completed by the end of July. I am therefore requesting the following under the Freedom of Information Act:

(a) The report produced by the hard review, or, if the review has not completed, the date by which the review is currently expected to report

(b) The terms of reference for the hard review

(c) The job titles of persons appointed to the hard review

(d) Any reports provided to the Secretary of State, the Minister of State or the Permanent Undersecretary of State and any email messages the above had with each other or others regarding the GTR franchise between 15 May 2018 (i.e. 5 days before the timetable change) and 3 August 2018. For the avoidance of doubt, it is only necessary to include those reports/messages for whom any of the above individuals were the "from" or "to" parties, but not if they were "cc"ed parties.

With respect to part (d) of my request, my request is for reports/communications regarding the GTR franchise, regardless of whether or not the communication pertains directly to the May 2018 timetable change. I understand it may be difficult to find all such records; I would be equally happy if a search were conducted for reports/communications that included any of the following keywords: "GTR", "TSGN", "Thameslink", "Great Northern", "Gatwick Express", "Govia".

In addition, your answer to part (c) of my request states that the Department has commissioned external advisers. If these advisers have been engaged in their individual capacities, please state the number of said advisers. If these advisers have been engaged in a corporate capacity, please give the names of the corporate entity/entities conducting the review.

Dear Department for Transport,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department for Transport's handling of my FOI request 'GTR Franchise and the Hard Review'.

My request has now had its response time limit extended six times, such that it is now two months over the standard 20 day time limit.

The Freedom of Information Act 2000 states:
"10(3) [...] the public authority need not comply with section 1(1)(a) or (b) until such time as is reasonable in the circumstances [...]"

I would consider two months of review under the public interest test to not be reasonable under the circumstances. Even if it were so reasonable, I would expect there to be some documents not affected by the public interest test that would be able to be released while the test is considered for the remaining documents.

For this reason, I am requesting an internal review as to whether the DfT has compiled with the Freedom of Information Act 2000.
