Dear City of York Council,

It is clear now that the regular meetings of the Group leaders are making decisions on matters that are not published, on evidence that is not published with minutes and actions that are not published. This includes but is not limited to a meeting you held to direct members to unlawfully go back to remote meetings, despite the fact legislation did not allow that and apparently with zero protocols to ensure Floyd did not go off and decide what he wanted instead of what the Members wanted.

Please provide the following
1. The terms of reference for this secretive committee.
2. The schedule of all leaders’ meetings from 1 April 2020 to present
3. The agendas, report packs and minutes and action notes from each meeting
4. The attendees of each meeting, members & employees.

Response – This information is not held. To assist further with your
understanding, we can explain there are no terms of reference as these are
informal meetings
 
Request 2 - The schedule of all leaders’ meetings from 1 April 2020 to
present
Response - In 2020 Meetings were more frequent to review the COVID/home
working/CYC situation.  We now have GL Meetings the week of Full Council
to discuss things such as seating arrangements, venue, any special
requirements for the meeting, etc.

Response – This information is exempt under the following section of the
FOIA - Section 36 ‘effective conduct of public affairs’
 
Reasons for applying exemption
These are informal meetings the purpose includes things such as ‘to review
the COVID/home working/CYC situation.  We now have Group Leaders Meetings
the week of Full Council to discuss things such as seating arrangements,
venue and any special requirements for the meeting’
 
Public Interest test
There is a public interest in people understanding how decisions are made,
however this is provided in the public meetings and the decision making
record which is publicly available.
The Group Leader Meeting is intended to give people a safe space to
consider and discuss proposed arrangements and special requirements for
meetings before moving discussions and outcomes to a public forum.
Providing this information publicly would be significantly likely, to
prevent people from being able to discuss and propose suggestions fully
and frankly.
 
The weight of public interest is therefore in favour of withholding the
information
 
Request 4 - The attendees of each meeting, members & employees
Response - Chief Operating Officer, Monitoring Officer, Head of Democratic
Governance or Head of Civic and Democratic Services, Democracy Officer,
Group Leaders (Leader, Deputy Leader, Leaders of Labour, Conservative,
York Independent Group).
Depending on the item discussed, other Chief Officers may be invited for
that agenda item for example, COVID updates would have the Director of
Public Health.
 
If you are dissatisfied with our response you have the right to ask for an
independent review of how your enquiry was handled and responded to. This

Dear City of York Council,

I am writing to request an internal review of City of York Council's handling of my FOI request 'Group Leaders Meetings'.

The leaders of the groups past and present have Indicated they have no problems with the agendas and minutes being published. Indeed, as the main leaders have agreed that these secretive meetings, outwith any democratic structure are inappropriate, and are now only held to discuss formalities for full council meetings, and the details requested are historic, it is the officers who appear secretive again, nor the members.

Please review and publish these papers, all of which are more than 18 months old.
