Dear Ministry of Justice,

I would like the MoJ to disclose who or what department at Grimsby Magistrates' Court dealt with (or should have dealt with) the correspondence below:

Yours faithfully,

Dear fFaudwAtch UK

Please note, under section 8(1) of FOIA, a request for
information must comply with three requirements. It must:

(a) be in writing,
(b) state the name of the applicant and an address for correspondence, and
(c) describes the information requested.

After initial consideration, this request appears to comply with requirements (a) and (c) but it does not comply with requirement (b) because you have not provided your full name.
I am therefore not required to process your request without information that can later be referred to, as per Section 8(1)(b) FOIA. The information we require is your name.
As your request has been deemed invalid, I am not obliged to disclose the requested information at this point and I would like to take this opportunity to recommend that any future FOI submissions adhere to Section 8 of the FOIA.
To enable us to meet your request, please resubmit your application in accordance with the above requirements. We will consider your resubmitted request upon receipt as long as it meets the requirements stated above.
You will then receive the information requested within the statutory timescale of 20 working days as defined by the Act, subject to the information not being exempt.
You can find out more about Section 8 by reading the extract from the Act available at the attached link:
http://www.legislation.gov.uk/ukpga/2000...

Kind regards

Dear Mr Gilliat,

This FOI reference was dealt with by the response you received on 27 April (see attached). I understand from colleagues that the query you linked to in your email of 27 April https://www.whatdotheyknow.com/request/a... was dealt with as treat official correspondence rather than as a Freedom of Information request relevant references are: TO16/1149 & TO16/1288. I take it you have not received a response?

Dear Wilson, Guy,

I have never had a response to this request and I don't know which requests these refer to (TO16/1149 & TO16/1288).

Dear Mr Gilliatt,

You received the attached email response to TO16/1288.

Furthermore the request at https://www.whatdotheyknow.com/request/a... is identical to that in FOI 104510. Therefore we have indeed responded to the crux of the request: "Please disclose all related material (statutory or policy) which lawfully permits or advises police forces that they may refuse to investigate allegations of perjury unless a request to do so comes from the court."

I hope this information clarifies the position, as far as I understand it.

Please direct any further queries on the matter direct to MoJ Data Access & Compliance Unit ([email address]), which is our central point of contact for Freedom of Information requests.

Dear Mr Wilson,

I'm going to go through this methodically because the MoJ has provided a response to the wrong request which seems to have caused the confusion.

For example I sent a message on 27 April 2016 as follows:

" Though I am grateful for the information provided it is actually the response to the request below:

https://www.whatdotheyknow.com/request/a... "

The request below (THIS REQUEST) was sent 18 March 2016 and as far as I know there has never been a response:

" Dear Ministry of Justice,

I would like the MoJ to disclose who or what department at Grimsby Magistrates' Court dealt with (or should have dealt with) the correspondence below:

https://www.scribd.com/doc/295501184/NEL... "

Yours sincerely,
