RESPONSE

Newry, Mourne and Down District Council holds the following recorded
information relating to your request:

 1. Given that this project is a joint cross border project, there have
been monthly meetings between Louth County Council (LCC) and Newry
Mourne and Down District Council (NMDDC) officials and their
consultants to take this project forward.  Engagement with the public
took place in regards the pre-application stages of the project.
Specifically, three Public Information events were held by the Project
in both the Republic and Northern Ireland, (Station House,
Carlingford, Co Louth – 19^th Feb 2019, Dolmen Centre, Omeath, Co.
Louth – 28^th Feb 2019 and Newry Arts Centre- 7^th November 2019). The
part 8 planning application process by LCC for the Greenway Sections
in the Republic of Ireland is in effect a public consultation process
whereby the public are afforded the opportunity to make submissions on
the project. It is worth noting that sections of land along the
proposed Greenway route remain unregistered and both LCC and NMDDC
have made every reasonable effort to contact the affected landowners.
The exact number of meetings are difficult to quantify given that the
project has commenced in 2017 and third party involvement/confirmation
would be needed.
 2. There have been no payments to any landowners on either side of the
border at this stage.
 3. Any issues or objections that arise to progress are being dealt with
through the ongoing planning process in Northern Ireland.  As
mentioned previously, LCC has submitted Part 8 planning applications
for two sections of this Greenway project. Both the Part 8 Planning
applications were approved and the submissions made by the public were
assessed as part of the Planners Report. The Planners Report is
available to the public on LCCs ePlan online inquiry portal.

land ownership and nature/ wildlife - these objections have been fully
considered. The land ownership query has now been raised with the
Council’s representative and a further consultation has been carried out
with the Northern Ireland Environment Agency with respect to wildlife/
nature concerns. All other matters raised within the objections can be
addressed through the normal planning process during the course of
processing.

 

The application is still under consideration. Information relating to this

How can this information not be held in writing? Presumably there would have to be a final date the "councils representative" would have to abide by to conclude the process?"
Please confirm if you are telling me this is NOT the case.
Please also confirm who the councils representative is that you refer to.

"Further consultation has been carried out

Same applies ,there would have to be a closing date to deal with this ,if this is the case please provide same.

Your requests are currently being processed under the Environmental Information Regulations 2004 however these regulations only cover recorded information. This means that under this legislation the Council does not have to provide explanation to answer a question unless the explanation is already held in recorded form. Similarly, the Council does not have to create new information or find out information to answer a question if it isn't already held in recorded form.

You have previously requested information formally under Freedom of Information/ the Environmental Information Regulations however members of the public can contact Council's Planning Department directly to obtain information relating to planning applications. Before I take forward your latest requests under the Environmental Information Regulations 2004 I would be grateful if you could confirm whether you wish to first consider having your requests dealt with as service requests by Council's Planning Department or by requesting to view or be provided with copy documents from the planning application file through Council's public access system.

There are thresholds within the Environmental Information Regulations 2004 in terms of costs to Council in processing requests and charges which can be made to requesters which may be relevant as additional requests are received. Where information is already accessible to the public, requests may be refused or charges levied under the Environmental Information Regulations 2004.

Under the Environmental Information Regulations 2004 you have requested
information from Newry, Mourne and Down District Council.  Your request
has been processed in accordance with the Environmental Information
Regulations and, accordingly, please see Council’s response below.
Council’s response follows previous responses issued to you under
reference AD EIR 801 relating to the same subject matter and follows
Council’s most recent response dated 28 May 2021 issued under reference AD
EIR 826.

RESPONSE

Newry, Mourne and Down District Council holds the following recorded
information relating to your request:

 

 1. An email was sent from the Planning case officer, Patricia Manley, to
Seamus Crossey, Council representative of the application, on the 7^th
May 2021 seeking clarification on land ownership.

 

 2. NIEA consultation was received on the 2^nd June 2021. The case officer
considered the content and re-consulted with NIEA on the 15^th June
2021 seeking site specific advice. The content of the NIEA response
and outgoing consultation letter is available on the Planning Portal
which can be accessed via the following link within the Consultation
Responses and Outgoing Consultation tabs of the Documents tab:

Regulation 6 (1)(b) of the Environmental Information Regulations provides
that:

 1. Where an applicant requests that the information be made available in
a particular form or format, a public authority shall make it so
available, unless –
(a) it is reasonable for it to make the information available in
another form or format; or
(b) the information is already publicly available and easily
accessible to the applicant in another form or format.

 

As information relating to this part of your request is available online,
I have applied Regulation 6(1)(b) of the Environmental Information
Regulations on this occasion to refuse this part of your request and I
have instead directed you to the Planning Portal where information is
available for public access.

         

 3. The Planning department received emails on the 18^th and 20^th May
2021 from Seamus Crossey enclosing the P2a and P1 form. The P1 form
was already available on the Planning Portal and the P2A added 26^th
May 2021. You can access these forms within the  Additional
Documentation section of the Documents tab of the Planning Portal
available via the following link

access the NIEA consultation response received on 2^nd June 2021 by
accessing the Consultation Responses section of the Documents tab on
