Rooney, Ruth, Newry, Mourne and Down District Council

Dear Ms O’Callaghan

I refer to the above and write further to my email dated 19 January 2021.

Under the Environmental Information Regulations 2004 you have requested
information from Newry, Mourne and Down District Council.  Your request
has been processed in accordance with the Environmental Information
Regulations and, accordingly, please see Council’s response below.

REQUEST

Greenway Omeath Road ,Newry

 1. How many meetings were held in relation to above in the last 2 years
by any method. Who attended and were invitations issued to all,
including the public.
 2. Please detail any payments made to landowners in relation to same,
including amounts paid and agreements in relation to.
 3. Were there any objections in relation to any aspects of progress?
Please outline.

RESPONSE

Newry, Mourne and Down District Council holds the following recorded
information relating to your request:

 1. Given that this project is a joint cross border project, there have
been monthly meetings between Louth County Council (LCC) and Newry
Mourne and Down District Council (NMDDC) officials and their
consultants to take this project forward.  Engagement with the public
took place in regards the pre-application stages of the project.
Specifically, three Public Information events were held by the Project
in both the Republic and Northern Ireland, (Station House,
Carlingford, Co Louth – 19^th Feb 2019, Dolmen Centre, Omeath, Co.
Louth – 28^th Feb 2019 and Newry Arts Centre- 7^th November 2019). The
part 8 planning application process by LCC for the Greenway Sections
in the Republic of Ireland is in effect a public consultation process
whereby the public are afforded the opportunity to make submissions on
the project. It is worth noting that sections of land along the
proposed Greenway route remain unregistered and both LCC and NMDDC
have made every reasonable effort to contact the affected landowners.
The exact number of meetings are difficult to quantify given that the
project has commenced in 2017 and third party involvement/confirmation
would be needed.
 2. There have been no payments to any landowners on either side of the
border at this stage.
 3. Any issues or objections that arise to progress are being dealt with
through the ongoing planning process in Northern Ireland.  As
mentioned previously, LCC has submitted Part 8 planning applications
for two sections of this Greenway project. Both the Part 8 Planning
applications were approved and the submissions made by the public were
assessed as part of the Planners Report. The Planners Report is
available to the public on LCCs ePlan online inquiry portal.

If you wish to discuss the above or require clarification on any matter,
please do not hesitate to contact me.

Dear Rooney, Ruth,

Thank-you for your response, though as previously stated you are now in breach of the required time limitation for reply under FOI as initial request was made on the 19 Jan 2021.
I fail to see how difficult it can be, to respond to this simple remaining part of the request :
3."Were there any objections in relation to any aspects of progress? Please outline."

It shouldn't be difficult to answer, and it shouldn't take until 20th April 2021 from 19th Jan 2021, so I would again request by return. Please do provide links to the applications you have referred to in you reply above.
The email address for Edel Cosgrove appears to have been omitted, perhaps you can clarify?
Thank-you.

Dear Ms O'Callaghan

Thank you for your request for information dated 14 May 2021.

Requests under the Freedom of Information Act 2000 and Environmental Information Regulations 2004 relate to recorded information held by Council. Therefore, if the answer to your question is not held in writing, under the legislation the Council does not have to answer your question if this would mean creating new information or giving an opinion or judgment that is not already recorded. Your request asks Council to create information and to provide you with future information, both of which fall outside the scope of this legislation.

You can access information relating to the application via the Planning Portal accessible via the following link: https://epicpublic.planningni.gov.uk/pub.... Information regarding this application can be accessed by entering the application reference LA07/2020/1082/F into the simple search function. Documents relating to the application can be accessed by clicking the documents tab when you have accessed the application search result. In addition, you can request a file viewing (currently not available due to COVID restrictions) or copy documents from Council's Planning Department directly by emailing planning @ nmandd . org

In accordance with Regulation 12(4)(a) of the Environmental Information Regulations 2004 the Council is refusing your request on the basis that the information requested is not held. You can access further information on how to formulate requests for information on the Information Commissioner's Office website which can be accessed via the following link: https://ico.org.uk/your-data-matters/off...

I trust this is of assistance. I have treated your request as a clarification request and not as a new request, however, should you be unhappy with our response in this matter you may request an Internal Review of our response by 16 July 2021. You can contact Ms Edel Cosgrove, Head of Compliance ([email address]) in that regard. In the event you are unhappy with the outcome of any Internal Review conducted by the Council you may apply to the Information Commissioner's Office (ICO) for a review of our response.

Maria O Callaghan

Dear Rooney, Ruth,

I am lost for words.

My question: "Can you please confirm the normal timespan to receive a reply in these circumstances?"

How can this information not be held in writing? Presumably there would have to be a final date the "councils representative" would have to abide by to conclude the process?"
Please confirm if you are telling me this is NOT the case.
Please also confirm who the councils representative is that you refer to.

"Further consultation has been carried out
with the Northern Ireland Environment Agency with respect to wildlife/
nature concerns".
Same applies ,there would have to be a closing date to deal with this ,if this is the case please provide same.

Getting basic information here seems to be akin to pulling teeth, and one has to wonder why.

Yours sincerely,

Maria O Callaghan

Rooney, Ruth, Newry, Mourne and Down District Council

Dear Ms O'Callaghan

Thank you for your email below.

Your requests are currently being processed under the Environmental Information Regulations 2004 however these regulations only cover recorded information. This means that under this legislation the Council does not have to provide explanation to answer a question unless the explanation is already held in recorded form. Similarly, the Council does not have to create new information or find out information to answer a question if it isn't already held in recorded form.

You have previously requested information formally under Freedom of Information/ the Environmental Information Regulations however members of the public can contact Council's Planning Department directly to obtain information relating to planning applications. Before I take forward your latest requests under the Environmental Information Regulations 2004 I would be grateful if you could confirm whether you wish to first consider having your requests dealt with as service requests by Council's Planning Department or by requesting to view or be provided with copy documents from the planning application file through Council's public access system.

There are thresholds within the Environmental Information Regulations 2004 in terms of costs to Council in processing requests and charges which can be made to requesters which may be relevant as additional requests are received. Where information is already accessible to the public, requests may be refused or charges levied under the Environmental Information Regulations 2004.

Should you wish to take forward your requests directly with Council's Planning Department, the planning email address is as follows: planning @ nmandd . org.

I look forward to hearing from you once you have considered the above. Should you wish to discuss, please do not hesitate to contact me by telephone or email.

Dear Rooney, Ruth,
The questions I asked in my previous mail ie.

1.Can you please confirm name of: Officer within Council’s Enterprise, Regeneration and Tourism
directorate you refer too.

3. No where can I see the points raised by objections lodged with you being addressed in any of previous replies, can you please provide a direct link to where this can be found?

Are basic, concise ,and the first two I presume should be a matter of record by now?
If the third has still not been been addressed can you please confirm this to be the case, and when it is likely to be?
(It would have to have a date to be concluded by I am advised)

Thank-you.
