Dear Mrs Mackenzie,

Thanks for your response dated 28/11/12.

Can you please respond with figures to the answers?

Presumably this will be all zeros if what you have said is to be taken at face value.

Can you tell me if there is an alternate term for 'Information Operations' in Scotland; or whether Grampian Police is involved in any Operations which involve the use of Psychological Warfare or Electronic Warfare?

Yours sincerely,

Donnie Mackenzie

Thanks for your response. You seem to have omitted an answer to the question on whether there was an alternate term for Information Operations in Scotland. I would appreciate if you could answer this.

In addition, I would like to add the folowing new request for information:

Please could you tell me if Grampian Police is involved in any joint agency operations which include surveillance?

If so, could you please specify how many operations and how many staff are committed to these for the date of my original request at the top?

Could you also please specify the total number of people who were the target of these operations for the same date?

Dear Ms McKenzie,

I consulted with my version of the FOIA, and section 35 pertains to Wales. But I found Law Enforcement in section 31.

Given that Strathclyde Police and Northern Constabulary have already responded indicating that they are involved in Joint Agency Operations, could you please provide clarification as to why such an acknowledgement might invoke the following legislation for Grampian Police?

-------------
31. (1) Information which is not exempt information by virtue of section 30 is exempt
information if its disclosure under this Act would, or would be likely to, prejudice-
(a) the prevention or detection of crime,
(b) the apprehension or prosecution of offenders,
--------------

As you mentioned in the response you wished not to mention anything giving an indication either way. So my presumption is you will probably decline to provide more detail rather than write in hypothetical language. If this is the case, please could you consider this a request for an Internal Review and acknowledge the initiation of proceedings in response.

Yours sincerely,

Donnie Mackenzie

McKenzie, Jody,

NOT PROTECTIVELY MARKED

Mr Mackenzie,

Grampian Police is a Scottish public authority, and therefore is bound by the Freedom of Information (Scotland) Act 2002, within which section 35 is the law enforcement exemption.

Responses under s.18 of the act do not require an articulation of the harm or public interest, as it could then unwittingly provide the information which is being withheld.

On this basis, I will begin review proceedings. A senior member of Grampian Police, who was not involved in the original request will undertake a review and a response will be relayed to you within 20 working days.

If you have any questions in the meantime, please get in touch.

Yours sincerely,

Jody McKenzie
