I write further to your request FOI.17.MERT059. In order for the CCG to
identify and locate the information requested we reasonably require
clarification from you on the scope of your request. Freedom of
Information Act 2000, Section 16 stipulates a duty for a public authority
to provide advice and assistance when they receive an unclear or ambiguous
request. Please provide clarification to the points below:

 

Does your request relate to GPs employed by NHS Merton CCG, such as
governing body members, or does your request relate to GPs who practice as
general practitioners in the Merton area.

Responses to FOI that are deliberately obtuse and obstructive confirm the publics opinion of authorities
It might help you to refer to your own web site re who your own GP practices members are .....it states there are 23 but the maths seems wrong as 15 for West Merton and 9 for East Merton is 24???

West Merton is made up of;
Registered Population: 145,513 patients

is made up of 15 member practices which look after around146,000 patients. Each practice is headed by one clinician who regularly meets with members and clinical leads of other localities.

I have already been very clear twice re my request
My FOI refers to all those CCG GP practice members as referred to above by the CCG on their own web site

Merton CCG is made up - according to your web site of 23 GP practices - all members who are signed up to and bound by the Merton CCG constitution - these are the GP members/practices my FOI refers to - those that are signed up to the Merton CCG constitution

As stated previously; “Merton GPs who are Merton CCG members”

I trust the deliberate holding questions and unacceptable delaying tactics will stop- please refer that matter of delays for internal review - it is very clear what is being done here

Thank you for your clarification. I can now take that back to the CCG and
your request can now be progressed. I can confirm that your request now
has a statutory due date of 29 August 2017. Public authorities always
endeavour to provide responses promptly, and at least within the statutory
timeframe set out by the FOI Act.

 

The FOI Act obliges public authorities to ask requesters to clarify an FOI
request if the original request is unclear. I would like to bring to your
attention that we initially emailed you to request clarification on 27^th
June 2017, and have only received a response from you today (1^st August
2017). Asking a requester to clarify a request is not intended as a
“delaying tactic”, but to ensure that the correct information is located
and provided.

 

Please note that the purpose of an internal review is to provide
requesters with the right to appeal a response to an FOI request, not the
public authority’s decision to ask for clarification. We are therefore
unable to process an internal review of this request at this stage as the
CCG have not yet provided their response.

As you have had my request for well over 40 days all parts not related to the clarity issue as to who your own CCG GP members are that is on your own web site - should have been answered by now
The question is simple it should not take another month to answer but I am sure it will par for the course
GPs are breaching the CCG constitution daily - and MCA 2005 legal rights and NHS legal rights - breaches that seem to escape the attention of the board of the CCG all run by Drs it seems ....

Breaches are investigated – the form of investigation would depend upon the nature and
scale of any alleged breach of the Constitution and would be covered by a number of CCG
policies with an appropriate investigator (internal or independent) assigned.

You say breaches are investigated - but also say none have been - which is correct ?
As you have given no names or departments who/what depatment should breaches of the CCG consitutuion be raised with in the CCG ?
eg Head of the CCG?

None.

Not applicable as there were no investigations for breach of the CCG’s constitution.

3. Who investigates complaints of breaches of the CCG constitution by GP members?
Breaches are investigated – the form of investigation would depend upon the nature and

policies with an appropriate investigator (internal or independent) assigned.

Please advise which deparment deals with and investigates complaints of GPs members who breach their own Merton CCG constitution and how members of the public get such matters addressed by Merton CCG
