Governor minutes at meetings

I would like to request the minutes of meetings held by school governors between July 2014 and November 2014.

I would like details, including written correspondence, of conversations between headteacher Carey Neil and current and former teaching staff relating to disciplinary action in the last 12 months.

Details of an investigation into allegations of bullying and harassment against Carey Neil.

The School will not confirm or deny if we hold any details of
conversations between the headteacher Carey Neil and current and former
teaching staff relating to disciplinary action in the last 12 months, or
details of an investigation into allegations of bullying and harassment
against Carey Neil. If this information exists it would be personal data
and would be exempt under section 40 of the Freedom of Information Act,
2000. This exemption applies to personal data when disclosure would
contravene any of the principles contained within the Data Protection Act,
1998.

 

Personal data is defined by the Act as data which is about or relates to
identifiable individuals. This definition applies to this data because the
headteacher is named and any other teachers involved in disciplinary
matters would be identifiable within the school community. The first data
protection principle requires data processing to be fair and lawful, and
in considering fairness, it is useful to balance the reasonable
expectations of the data subject against the legitimate public interest in
disclosing the information. In this case, any teachers involved in
disciplinary action or in any investigation into allegations of bullying
and harassment, would reasonably expect that details about this would
remain confidential, and would not be revealed to the world at large
(which disclosure under the FOI Act has to be considered as). Further, it
is not considered that disclosure of this data would be in the public
interest. This decision is supported by the decision in Gibson v
Information Commissioner and Craven District Council (EA/2010/0095), in
which the Information Tribunal found that the legitimate interest of the
public only outweighed the prejudice to the rights, freedoms or legitimate
interests of the individual concerned to the extent that the information
concerns the use of public funds. The data requested here is about
disciplinary action and allegations of bullying and harassment, and is not
about the misuse of public funds. Therefore, disclosure of this
information would not constitute fair processing, and so the exemption
provided by section 40 is engaged. In accordance with the Freedom of
Information Act 2000 this is a Refusal Notice.

I am dissatisfied with your response. You have not referenced my request for the minutes of governor's meetings.
I would therefore like to re-iterate my request for a full disclosure of the minutes of meetings held between the school governors from July 2014 to present.
I would not expect my request to take a further 20 days to process seeing as this is something you have omitted from my previous request.

The Summer term Full Governing Body meeting was held in June, rather than
July of 2014. The next Full Governing Body after that was held on 11h
November 2104, and minutes have not yet been completed.

Google has notified us that due to a request under data protection law in Europe, Google will no-longer be listing this request in search results for certain queries for names or other personal identifiers. Google has informed us that this only affects search results offered by European versions of Google.

When contacting us to tell us about this Google noted the request will still appear in the results for other searches. Google didn't disclose which searches this request will no-longer appear in response to, and pointed out that in many cases affected queries don’t relate to the name of any person mentioned prominently on the page.

Google has invited us to make representations to them if we want to make the case for reversing their decision.
