Dear Universities UK,

I note from the FOI request below that St Mary’s University Twickenham state that they need not be compliant with s.5 of the Health Protection Coronavirus Regulations Act because they are not an holiday accommodation provider.

My understanding of the FOI request is that all accommodation providers were to cease business wherever possible, but could remain as an accommodation provider where people could not return home safely.

Accommodation

Holiday accommodation must close. This includes hotels, hostels, bed and breakfast accommodation, holiday apartments, home, cottages or bungalows, campsites, caravan parks or boarding houses, canal boats or any other vessel unless the exemptions set out in law apply.

You can only carry on your business and keep your premises open in order to provide accommodation for people who:

Are unable to return home, or use the accommodation as their main residence.

Can you please tell me if section 5 (3) & (4) (a) (i) of the Health Protection Coronavirus Regulations Act is not applicable to St Mary's University as per St Mary's FOI reply or did St Mary’s University have to be compliant with the said legislation?

Dear Steven,

My sincere apologies for the late response, as you can imagine we have been inundated with queries, so I apologise for not responding at the time.

Universities UK is not subject to the Freedom of Information Act 2000. We can also not comment on individual complaints about universities.

I would recommend contacting the DfE and UK government to find out this information regarding the regulations you mention, as we are not the regulator. If you are unhappy with how the university has handled a complaint you can forward it to the OIA, the independent body set up to review student complaints about higher education providers in England and Wales. I am sorry we could not be of more assistance.
