Governance issue

Dear Her Majesty’s Inspector of Constabulary for Scotland,

The Audit Scotland Annual Audit report 2011-12 states ".....we note that HMICS are in the process of undertaking a review of the governance arrangements relating to the post of Assistant Chief Constable. This review is expected to report its review in 2013"

The same report later states "We understand that Her Majesty's Inspector of Constabulary for Scotland has recently launched an investigation into the Board's handling of the case. We will continue to monitor progress in this area with a view to considering the effective use of public monies"

Could I please have a copy of the terms of reference for that investigation together with a copy of the report

I am writing to request an internal review of Her Majesty’s Inspector of Constabulary for Scotland's handling of my FOI request 'Governance issue'.

[The response does not state which exemptions you seek to apply to the various elements of my request.

The inference that because the report refers to individuals it is necessarily exempt (my interpretation of your reply) is rather nebulous to say the least

The reference to ongoing discipline proceedings may be correct (I don't accept that it is at this stage without further details on which exemptions you are claiming) but as a matter of fact most of the discipline charges were actually dropped some months ago so there seems to be some scope for redaction to satisfy my request.

I would remind you of your reply to an earlier request about senior officer discipline proceedings when you confirmed that you had no statutory or advisory role in such proceedings

In the same previous response you confirmed that "HMICS commissioned an independent review in relation to the application of policy, procedure, regulation and process by the Central Scotland Joint Police Board"

This would appear to be the same report quoted in my latest request and as such there appears to be no reference to an individual that would amount to personal data....... it is an audit of an objective system (or more lackly the lack of one)

The quote about "effective use of public monies" attributed to Audit Scotland seems to confirm my view that this is a matter of public interest

Have you actually ever asked any of the individuals you are apparently to protect whether they actually want your protection?

I attach a copy of Decision 208/14 for your ease of reference

"Decision
The Commissioner finds that Her Majesty’s Inspectors of Constabulary (HMICS) partially failed to
comply with Mr Roulston’s request for information in accordance with Part 1 of the Freedom of
Information (Scotland) Act 2002 (FOISA). The Commissioner finds that:
• by failing to disclose information that did not comprise personal data, HMICS failed to comply
with section 1(1) of FOISA
• HMICS was not entitled to withhold information under the exemption in section 38(1)(a) of
FOISA
• HMICS incorrectly applied the exemption in section 38(1)(b) of FOISA to some of the withheld
information
• HMICS was entitled to withhold some of the personal data under the exemption in section
38(1)(b)
The Commissioner therefore requires HMICS to disclose to Mr Roulston the information specified
in paragraphs 26, 67 and 72 above by 10 November 2014."

Could you please confirm when you are going to supply the requested information?
