there are far more FOI requests that have been submitted re these campaigns too. I am aware a number of charities have submitted requests, I have, newspapers have. Beyond belief that nobody has got an official response with the information requested.

The Information Commissioner has received a complaint from Mr Musial stating that no response has been sent to an information request submitted to your organisation on 11/09/13, which you have acknowledged as having been received.

Any public authority in receipt of such a request is under a duty to respond within 20 working days of receipt. As you have not responded but did acknowledge receipt of the request, please now respond within 10 working days of receipt of this letter.

You should state whether or not the information is held in a recorded form. If it is held, you should either provide the information or issue a refusal notice in accordance with the requirements of section 17 of the Freedom of Information Act or regulation 14 of the Environmental Information Regulations as appropriate. 1. The complainant requested information about the handling of previous
requests for information relating to the “Go Home van campaign”. The
Home Office failed to respond to this request within 20 working days of
receipt and in so doing breached section 10(1) of the FOIA.
2. The Commissioner requires the Home Office to take the following step to
ensure compliance with the legislation.
• Provide a response to the request.
3. The Home Office must take these steps within 35 calendar days of the
date of this decision notice. Failure to comply may result in the
Commissioner making written certification of this fact to the High Court
pursuant to section 54 of the Act and may be dealt with as a contempt
of court.

4. On 11 September 2013 the complainant wrote to the Home Office and
requested information in the following terms:
“There seem to be lot of delays in your answering to the FOI requests
re "Go Home" Van campaign.

5. At the time of writing the Home Office had failed to respond to this
request.
Scope of the case
6. The complainant contacted the Commissioner on 30 October 2013 to
complain about the failure by the Home Office to respond to his request.
On 16 January 2014 the complainant contacted the ICO again and
confirmed that he had still not received a response to his request.
Reasons for decision
7. Section 10(1) of the FOIA provides that a public authority must comply
with an information request promptly and in any event not later than
the twentieth working day following the date of receipt. In this case the
Home Office has breached section 10(1) by failing to respond to the
request within 20 working days. At paragraph 2 above the Home Office
is now required to respond to the complainant’s request in accordance
with the FOIA.
Other matters
8. As well as finding above that the Home Office is in breach of the FOIA,
the Commissioner has also made a record of the delay in this case. This
may form evidence in future enforcement action against the Home Office
should evidence from other cases suggest that there are systemic issues
within the Home Office that are causing delays.

I would like to raise couple of points as below:

1. Home Office in their review says:

Request background

1. The above dates reflect the information we have recorded for FOI reference 30941. There are a number of discrepancies between this and the information on Whatdotheyknow.com. The Home Office does not appear to have a record of ever receiving this request in September 2013 and no action occurred until the ICO decision notice FS50518683 of 21 February 2014.

This information is untrue. Home Office initially responded to the request on 26th September as follows:

Dear Marcin Musial

Thank you for your e-mail of 11 September 2013, in which you ask for information about the pilot schemes encouraging illegal immigrants to return home. Your request is being handled as a request for information under the Freedom of Information Act 2000.

(...)

we need to extend the 20 working day response period. We now aim to let you have a full response by 24 October 2013

As it clearly shown above, the Home Office breached the FOI Act in their unreasonable delay to respond to the request.

2. Home Office refused the information based on section 40(2) - Personal Data.

My request was for the INTERNAL correspondence (I. e. correspondence between members of Home Office staff), not for the correspondence between requesters and Home Office. Furthermore, the correspondence between requestors and Home Office is also public as it appears on WhatDoTheyKnow website.

I fail to see how the correspondence between members of HO staff is a personal data.

I however suspect that Home Office is covering up the true reasons why ALL the requests regarding "Vans Of Hate" were delayed until political announcement was made public. Therefore I believe there is a strong public interest to demonstrate if Home Office prioritise political interest of Tory Party above the letter of law.
