Thank you for your email of 4 November asking for information relating to
our recent consultation on regulating Anaesthesia Associates and Physician
Associates. I’ve considered your request under the Freedom of Information
Act 2000 (FOIA).
1. Please advise the criteria used to determine whether a response
received was "out of scope"
The consultation was on our proposed rules, standards and guidance for the
regulation of PAs and AAs. Our [1]consultation document laid out the
parameters of the consultation in the sections “What we’re consulting on”
and “What this consultation is not about” on pp. 2-4. However, we did
consider all the feedback we received and will publish a detailed report
before regulation starts in December.
2. Please provide copies of the responses considered to be "out of
scope". I appreciate you may need to redact personal data from the
responses, where consent for the response to be shared is not held by
the GMC.
I can’t provide the information you have asked for as it was obtained in
the course of an ongoing programme of research.
The exemption
Section 22a of the FOIA applies to information obtained for the purposes
of research, where the research is ongoing and there is an intention to
publish a report on it in future. The exemption applies to the raw data
regardless of whether it’s included in the published report, although this
exemption can’t be applied after publication.
In this case we intend to publish a report with the conclusions of the
consultation later this year. This exemption is subject to a public
interest test and I believe that the public interest in maintaining the
exemption outweighs the public interest in disclosing the information.
Your right to appeal
I'm sorry I couldn’t provide all the information you requested. If you
would like to appeal this decision please set out your reasons in writing

appeals received within 40 working days of our response. You can also
