Response to request dated 28/06/2024 made under the Freedom of Information

Questions and Response:

 

Section 1 of the Freedom of Information Act 2000 (FOIA) – establish if
information is held

In accordance with Section 1 of the FOIA, we can confirm that the Trust
does hold some of information you have requested.

 

1) Gender reassignment and/or transgender guidance and policies relating
to staff - attached: Transitioning in the workplace and Transitioning in
the workplace procedure and WHH Uniform and Workwear policy.

 

2) Gender reassignment and/or transgender guidance and policies relating
to patients

 

Section 1 of the FOIA – establish if information is held

 

In accordance with Section 1 of the FOIA, we can confirm that the Trust
does not record/collate the above information. The Trust can confirm that
we do not currently have any guidance or policies in place relating to
Gender Reassignment (and/or transgender) for patients. We should explain
that the FOIA is in relation to transparency of information held by public
authorities and gives an individual the right to access recorded
information held by public authorities. The FOIA does not require public
authorities to create information, or to answer questions, provide
explanations or give opinions, unless this is recorded information that
they already hold.

 

Section 16 of the FOIA – duty to provide advice and assistance

In accordance with Section 16 of the FOIA, the Trust has a duty to provide
advice and assistance as part of any request. On this occasion, we can
confirm that Gender Reassignment Patient Support will be covered in our
Eliminating Mixed Sex Accommodation Policy, which is currently being
re-drafted and therefore, we are unable to share a copy at this moment in
time and therefore not yet been finalised/approved/ratified.

 

 

3) Related Equality Impact Assessments if separate These are included
within the policies as a mandatory template to be completed.

 

4)  Policies on mixed sex and/or same sex accommodation – attached:
Discharge suite SOP, Transfer of patients and clinical handover policy, as
mentioned above our Eliminating Mixed Sex Accommodation Policy is
currently being re-drafted and therefore, we are unable to share a copy at
this moment in time as it has not yet been finalised/approved/ratified.
