Gender balance on public boards in Scotland

Dear The Office of the Scottish Charity Regulator,

This is a Freedom of Information Request.

In November 2015 The First Minister made a commitment to work towards gender balance on all public boards in Scotland.

Please could you supply me with the following information?

1. At November 12 2015, how many men and and how many women were on the board of your organisation?
2. At November 12 2015, was the Chairperson (or person with an equivalent role) a man or a woman?
3. How many men and how many women are now on the board of your organisation?
4. Is the current Chairperson (or person with an equivalent role) a man or a woman?
5. Does the board have a formal strategy or policy commitment to achieving gender balance? If so please supply a copy of the document where the policy is laid out. Please also confirm the date that this policy was adopted.
6. What is the current median FTE pay for men and women in the organisation?

Please do not send the requested information in pdf format files. I would prefer to receive the requested information by email in a machine readable format such as MS Excel.

I am responding to your questions about the Gender Balance on Boards in particular the Board of the Office of the Scottish Charity Regulator. I do not intend to provide this information on a spreadsheet, we do not have it in that format, all the information you request is publicly available at the links below.

Questions 1-4

There are two places where you should find the information you require the first is our website and the other is on the Appointed for Scotland website.

6. What is the current median FTE pay for men and women in the organisation? We do not calculate this separately by gender, the annual accounts 2016-17 p21 give the most recently calculated median FTE pay for all staff.

I am writing to request an internal review of The Office of the Scottish Charity Regulator's handling of my FOI request 'Gender balance on public boards in Scotland'.

Whilst I appreciate the prompt response given to my initial request, I do not accept that the organisation does not hold information sufficient to work out the median pay of men and women in the organisation.

Dear Mr Tibbitt,

In response to the review request there are two things which I must advise you of.

1. We did not accept that this was a valid FOI request and we responded to you with direction to information which is publicly available and which would in the main answer your question.
2. Even if we considered that this query was a valid Freedom of Information request section 1(4) of the Freedom of Information (Scotland) Act 2002 states
'The information to be given by the authority is that held by it at the time the request is received, except that, subject to subsection (5), any amendment or deletion which would have been made, regardless of the receipt of the request, between that time and the time it gives the information may be made before the information is given.'

As I stated in the reply we have never calculated that information and therefore we do not hold the information in the form you request so it would not be information we have to supply under the Freedom of Information (Scotland) Act.

As this is not considered by OSCR to be a valid FOISA request you have no right of review.
