Dear Mr Fitzsimons

Request under the Freedom of Information Act 2000 (the Act)

East Midlands Councils has considered your request which was received on 2nd December 2017 and our response to your question is shown below.

‘Please may I have a copy of any guide you have for your customers on their GDPR rights.’

Finalised guidance for the public relating to their rights under GDPR is not yet fully complete. It will be published in 2018; the exact date is not known as this is dependent on the UK government and the date the current Data Protection Bill (the final content of which will affect our advice to the public regarding GDPR) is passed as Act of Parliament.

The FoI Act allows public authorities to best manage the necessary preparation, administration and context of publication of the information. Given that the information requested is guidance for the public, it is clearly in the public interest to ensure that the guidance is complete before publication and covers both UK and EU law where applicable as this will provide the public with the most complete advice. This can only be achieved once the legal position of the UK government on GDPR is finalised.

To avoid providing partial and/or misleading guidance before the new Data Protection Act is passed EMC feels it is in the best interests of the public that we withhold the requested information, as the requested information will be published and freely available next year.

As we are withholding the requested information under s.22 of the Act, please accept this email as a refusal notice issued in accordance with s.17 of the Act.

If you are unhappy with the response provided you can ask for an internal review by email to EMC Executive Director ([email address]) stating the reasons for your dissatisfaction.
