Could you please answer this FOI request as a matter of urgency.

Who is responsible for live gas pipes in a common area of a multiple building?

The building in question is a Grade Two Listed building which houses 22 private apartments. The live gas pipes in question are situated in a basement area of the building which is not a dwelling and is not accessable to any of the leaseholders. The said area has no windows or direct access.

Thank you for your response however this response does not address my urgent Health and Safety concerns sadly.

I understand your response is totally generic and in any normal circumstances it would have explained who is responsible for live gas pipes in a basement common area. However the live gas pipes in question which are housed in the damaged ceiling of this common area basement space in a multiple building have already corroded once and caused a major gas leak which resulted at the time in the whole building being evacuated by Cadent at 2am.

After a recent FRA on the building which I had to personally action as an extremely concerned leaseholder and due to my major concerns for the Health and Safety of all of it's residents in the building (22 apartments). The building in question had not had a legally required FRA taken out on it in over 20 years and the common area basement in question was described in this recent FRA in it's current state as being a danger to life! This common area basement space which holds the gas pipes in question has no windows or doors and can only be accessed via a hatch in the communal hallway. This hatch has been nailed down with hundreds of nails to prevent access. The agent and service provider of the residents manaagement company of the building are the company responsible for nailing this hatch down, they are the only people who can obtain access to this dangerous common basement area space.

In light of the seriousness of this situation and as the gas pipes in question can not be accessed by anyone other than the agent/service provider who act on behalf of the residents management company can you therefore please tell me under these exact and dangerous circumstances.

WHO IS RESPONSIBLE FOR THE SAFETY OF THESE GAS PIPES AND AS A DIRECT CONSEQUENCE THE SAFETY OF ALL RESIDENTS IN THIS MULTIPLE BUILDING?

I have been in touch with out Gas team in regards to this, they assisted with the initial response. They have advised the following;
"Unfortunately we are missing some crucial information, which we would need to gather to understand who the duty holder is here.

Dear Cameron,

Thank you for your advice however I have tried calling the number you suggested and simply can't get through.

Could you please refer back to your Gas Team and ask them what crucial information it is that they require in order to establish who the duty holder and therefore the responsible person of the building is!?

As I stated in my earlier email, the buildings residents managing company is Prince Alfred Court (1992) Ltd and their acting agent is Northwest Housing Services.

My understanding is that Prince Alfred Court (1992) Ltd and it's two directors are responsible for the Health and Safety of all common/communal areas's. The basement in question which holds these gas pipes is a common area and has no windows or doors and can only be accessed via a hatch in the communal hallway. This hatch has been purposely nailed down to prevent access by Northwest Housing Services the acting agent for Prince Alfred Court (1992) Ltd.

I need to get to the bottom of this pretty simple question as I am about to send a large file to HSE London.

I will be sending out an extensive file this week to HSE London and Robert Jenrick on the disturbing handling and findings that HSE Liverpool (Helen Jones and Damian Hilton) came to under the direct influence of Louise Connelly the LCC Private Sector Liscencing Manager on a serious Health and Safety, life threatening situation on a multiple Grade Two Listed building.

I will be sending all correspondence from HSE Liverpool (Helen Jones, Damian Hilton) and all reports/evidence that I submitted to HSE Liverpool starting from August 2019 to London and will be including the more recent correspondence via the WhatDoTheyknow site therefore a reply to my last email to you would be much appreciated.
