Please provide all information related to the recent Garelochead Medical Practice vacancy.

This includes, but is not limited to, emails, minutes of meetings, minutes/records of telephone conversations, letters, documents.

In addition copies of the following are specifically requested:
• The decision regarding the choice of tendering process / single handed vacancy
process.
• Any discussion of Procurement Regulations, or the application thereof.
• The choice of interview committee members and any discussion of conflict of interest.
• Whether any of the committee members had any prior relationship with any of the
tendering businesses (eg: were any of the interview panel patients or colleagues of one of the bidding practices).
• Any correspondence/records of discussion between Dr McLachlan and Partners Medical Practice Helensburgh, a bidder at the last round, and any officers/employees of Highland Health Board regarding the practice without time limit.
• Any correspondence/records of discussion between Dr McLachlan and Partners Medical Practice Helensburgh, a bidder at the last round, and any officers/employees of Highland Health Board regarding provision of community nursing services in the area without time limit.

The public interest for this request is that procurement regulations are designed to provide the best value for money and the best care for patients when appointing companies to run health services and that any erosion or circumvention of procurement regulations has the potential to produce poor care for patients and increase costs for the Health Board and tax payers.

Dear Highland NHS Board,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Highland NHS Board's handling of my FOI request 'Garelochead Medical Practice Vacancy'.

The public interest in the request includes that of ensuring effective oversight of expenditure of public funds and that the public obtain value for money as well as ensuring that patients receive the best available health care.

I wish to request a review on three grounds:

1. The information provided is incomplete. The information supplied is extensive but is almost exclusively of the “are you free to meet on Tuesday?” “Yes, I am” variety, and it is not possible to see how the Health Board arrived at the decisions it made from the information provided. That is to say, the information states the decisions that were the subject of the request were made, but the decisions appear to have been made ‘by magic’ without anyone meeting or discussing what decision to come to. Ipso facto, the response is incomplete.

2. The information the Health Board has provided has been heavily redacted to the point that the information cannot be of use in achieving the above public interests. The redaction includes removing all details of the Health Board officers involved from all the documents supplied. No reason has been given for the redaction.

3. The Health Board has withheld unspecified documents on the basis that they are exempt under Section 33 of the Freedom of Information (Scotland) Act 2002. Section 33 exemptions are not absolute, and require a two stage process: (i) would the information “prejudice substantially” the affected parties commercial interests, and (ii) does the public interest in releasing the information outweigh the public interest in withholding the information. The Health Board did not provide details of the public interest test it applied in applying the exemption.
