Dear Essex Police, within the area of your
constabulary, have vehicles and/or drivers operating on behalf of
G4S (in any capacity), how many have in the past 2 years:

a) been cited for any breach of the Road Traffic Acts and
associated Regulations (inclusive of the Highway Code),

b) been prosecuted for s for such breaches.

Thank you for your enquiry which has been logged under the above
reference.

Under the Freedom of Information Act we are required to reply within 20
working days.  The Act does not specify a limit to the number of
information requests a public authority may receive or the number of
requests or questions an applicant may submit.  However, there are
exemptions in the Act that can apply and these include where the cost of
complying with the request would extend beyond the reasonable cost limit,
(currently 18 hours or £450), or if the request is otherwise manifestly
unreasonable in its scope or nature.  Requests that ask a great many
questions, or a number of detailed requests submitted at the same time,
may make it necessary for Essex Police to refuse the requests wholly or in
part.

providing oversight and guidance for the legislation and they have

reference. Having completed my enquiries I am able to respond as follows:

Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties
on public authorities. Unless exemptions apply, the first duty at
Sec1(1)(a) is to confirm or deny whether the information specified in a
request is held. The second duty at Sec1(1)(b) is to disclose information
that has been confirmed as being held. Where exemptions are relied upon
s17 of FOIA requires that we provide the applicant with a notice which: a)
states that fact b) specifies the exemption(s) in question and c) states
(if that would not otherwise be apparent) why the exemption applies.

In respect of your enquiry:

Within the area of your constabulary, have vehicles and/or drivers
operating on behalf of G4S (in any capacity), how many have in the past 2

Essex Police does not hold information relating to your request.

 

I am advised as follows:

 

We would be unable to search this one as the data is not stored in this
way.

 

On receipt of an image forms are sent to the registered keeper which may
be G4S, when the forms are returned with the drivers details the G4S entry
is replaced, therefore a search would not identify the offenders employer.

 

I am sorry we are unable to assist you on this occasion.

Dear Steve Grayton 42008330, I write to gain clarification of your response:

Are you stating that your records of road traffic offences are insufficiently rigorous, that no detail of driver or keeper road traffic offences would be available to mount any prosecution.

Or are you saying that you don't keep any records of such offences.

Or are you implying that you don't keep records of offences associated with G4S.

To clarify my reply:

 

It is the driver of the vehicle that commits the offence not G4s, so once
G4S (as owner of the vehicle) has advised the Force who the driver was the
process proceeds against that named driver not G4S.

 

The Force does not keep records of offences by Registered Keeper, i.e. G4S
but by driver details – the person committing the offence.

 

I would be interested in why you think we should record the data as you
suggest  “of offences associated with G4S” when it is the driver not G4S
who commit the offence.

 

Perhaps you could explain what you are trying to achieve and I’ll see if
we can help further?
