request to Nottinghamshire County Council for a list of documents relating
to works at Halloughton Road, Southwell.

 

I can confirm that the Council may hold some of this information. However
it is not held in a format that allows it to be readily extracted or
produced in a list format. To do so would require the searching and
reading of hundreds of pieces of correspondence.

 

You may be aware that there is a statutory limit to the amount of time
authorities are required to spend in order to comply with a request. This
is defined in the Appropriate Limit and Fees Regulations as 18 hours. 

 

We estimate that it will take one officer in excess of this limit to
locate and retrieve the information you have requested. Therefore in
accordance with Section 12 of the Freedom of Information Act we will not
be able to provide this information.

Dear FOI,

Following your latest response, can you please allocate an officer to start the process of sifting the documents and listing them for a maximum of fifteen hours and the sending me the results. It would be appropriate if the first list was the available information available electronically and then working backwards in time from the last communication that was received or sent on paper based material.

There is local concern about the way in which the issue was and is being handled by the NCC and it would be reassuring if at least some of this information was available for public scrutiny.

Whilst I accept your argument, although I am not happy about it - given the very serious concern about how the NCC have behaved in the substantive matter that I have raised and despite repeated suggestions for reducing the scope of the request, I am finding it difficult to get below the time allocation that your officers have indicated it would take. With regard to your request for information about water flow at
Halloughton Road, Southwell, I can advise you as follows.

 

The county council’s role is one of statutory consultee, commenting on
proposals for the management of surface water put forward through the
Local Planning Authority, in this case Newark and Sherwood District
Council.

 

All information, including design calculations, relating to the management
of surface water for the development is available through Newark and
Sherwood District Council’s (as Local Planning Authority (LAP)) Planning
Department and online facility. Any formal communication we have as
Statutory Consultee with NSDC regarding the application is also held on
their website. As LPA  Newark and Sherwood are decision makers in the
planning process.
