Dear Kane Powell

Please find below a copy of our response first sent to you on 26 May 2015

Thank you for your request for information.

Could you please supply me with information regarding:
- a yearly total of all funding (including council funds, local, UK and EU grants) provided to Playing out for the past 4 years.
- submissions provided by Playing Out for their application to the Bristol Green Capital grants fund.
- pitches or submissions produced by Playing Out in support for applications for council funding.

Please find attached the documents requested.

In addition they also provided documentation which is already in the public domain (and available by other means) and have identified that Section 21(1) is engaged in relation to this information. Section 21(1) of the FOIA confirms that:

"Information which is reasonably accessible to the applicant otherwise than under section 1 is exempt information."
This information is available via http://wck2.companieshouse.gov.uk//wcfra... .

We can confirm that some of the information in the documents being disclosed has been redacted as section 43(2) (Commercial Interests) is.
Section 43(2) of the FOIA confirms that:

"Information is exempt information if its disclosure under this Act would, or would be likely to, prejudice the commercial interests of any person (including the public authority holding it).

The Public Interest in disclosing this information is outweighed by the Public Interest in withholding the information. Playing Out is a not-for-profit company with a social purpose and there is relatively low public interest in the disclosure of this information, outweighed by the detriment to the business operation of Playing Out.

It has also been identified that section 40(2) (Personal Information) is engaged for some or all of the information that you have requested.

We consider that this information is personal data as due to the small number of staff it would be possible to identify individual salaries etc and that this information would therefore be about an identifiable individual and therefore personal.

Section 40(2) of the FOIA confirms that:

“Any information to which a request for information relates is also exempt information if –
1.it constitutes personal data which do not fall within subsection (1), and
2.either the first or the second condition below is satisfied

Section 40(3) of the FOIA confirms that:

"The first condition is
3.in a case where the information falls within any of paragraphs (a) to (d) of the definition of “data” in section 1(1) of the Data protection Act 1998, that the disclosure of the information to a member of the public otherwise than under this Act would contravene 1.any of the data protection principles, or
2.section 10 of that Act (right to prevent processing likely to cause damage or distress)

The redacted documents are;

4.Playing Out Business Plan 2014 – 2019
5.Playing Out Budget Overview 2014-15
6.Playing Out Budget Overview 2015-16
7.Playing Out Management Accounts
8.Playing Out Project Budget
9.Playing Out CIC Accounts

It should be noted that accounts information will be available from the companies house link in due course.

This response should answer your request in full, however if you are not satisfied with this response or wish to lodge an appeal against any exemptions that may have been applied, you can do so by writing to the Data Protection Officer at Bristol City Council Legal Services, The Council House, College Green, Bristol, or [Bristol City Council request email]. Details of the complaints procedure can be found at http://www.bristol.gov.uk/complaints.
