Dear Ms Goulding,

 

Thank you for your information request, dated 19 July 2018, where you
asked for “total revenue (including fees, funding or any other monies
received) you received from Pfizer in the last 5 financial years?  Please
break this down into financial years.” You further clarified that you were
seeking this information in relation to Pfizer companies worldwide.   

 

I can confirm that the MHRA does hold some of the information that you
have requested. However, we have also determined that the information is
exempt under Section 12 of the Freedom of Information Act and we cannot
process your request any further.

 

Section 12 of the Act allows public authorities to refuse requests where
the cost of dealing with them would exceed the appropriate limit, which
for central government is set at £600. This represents the estimated cost
of one person spending 24 working hours in determining whether the
department holds the information, locating, retrieving and extracting the
information.

 

In order to process your request, we would need to deploy someone to
extract this information for each Pfizer account across multiple financial
systems, group and summarise the data by financial year for the 5 year's
of information. We consider that this would take longer than 24 working
hours to complete.

 

Please note that substantially similar requests made within 60 working
days of an original request can be aggregated into one for the purposes of
calculating a cost limit, meaning that section 12 could still apply.

 

If you disagree with how we have interpreted the Freedom of Information
Act 2000 with regards to your request, you can ask for the decision to be
reviewed. The review would be carried out by a senior member of the Agency
who was not involved with the original decision.

Can you please reconsider this request, by reducing the time-frame from 5 years to either 2 or 3 years if need be?

I feel that the estimate of over 24 hours is unreasonable as this is basic information that would be captured within your financial accounting systems. I have direct experience of running a similar report, using financial systems, where running a similar report took less than 1/2 an hour. Please reconsider and reduce the number of years to try to accommodate this request.

Thank you for your information request dated 12/09/2018 where you asked
for information regarding MHRA revenue from “companies with 'Pfizer' in
the legal entity name”.

 

To summarise your previous requests, our understanding of the broader
request you are making is for total revenue (including fees, funding or
any other monies received) received by MHRA from any companies MHRA
interact with that have the name 'Pfizer' in the legal entity name in the
last 5 financial years (or if need be a reduced timeframe of 2 years).

 

We can confirm that the MHRA does hold some of the information that you
have requested. However, we have also determined that the information is
still exempt under Section 12 of the Freedom of Information Act and we
cannot process your request any further in its current form. We have
explained why in further detail below. As this is not the first time we
have outlined this position, we have also gone into further detail about
how you can narrow your request to make it possible to disclose some of
the information.

 

To explain our use of Section 12, the data requested is held across two
finance systems (one of which has been discontinued) and there is no
standard report we can run for what you have requested. This will require
a specialist resource to interrogate our previous financial system and the
new system which we implemented last year. The data will then have to be
reformatted in order to be in a presentable format for the 40+
accounts/legal entities with the word ‘Pfizer’ in them. Pfizer is a
complex and large international firm with multiple arms and “revenue”
would include all income from all of the Agency’s services and functions.

 

Section 12 of the Act would apply where the cost of dealing with this
would exceed the appropriate limit, which for central government is set at
£600. This represents the estimated cost of one person spending 24 working
hours in determining whether the department holds the information,
locating, retrieving and extracting the information. We consider that this
would take longer than 24 working hours to complete.

 

To narrow your request, we suggest you restrict it to one named Pfizer
account/legal entity (eg. Pfizer UK, Pfizer Inc). For example, you may
wish to request information on the largest Pfizer account/legal entity.
This may make the request viable although we cannot guarantee this will
avoid triggering the limits outlined by Section 12.

 

Please note that substantially similar requests made within 60 working
days of an original request can be aggregated into one for the purposes of
calculating a cost limit, meaning that section 12 could still apply.

 

If you disagree with how we have interpreted the Freedom of Information
Act 2000 with regards to your request, you can ask for the decision to be

that the time period covered by the current finance system is 1 November
2017 to 30 September 2018. If we are using that time period, it is much
