Also this information will contain the standard that was requested by OMBC to the contractor under tender and the statutory obligations that OMBC would have been aware of at the time of request.

Please could you let me know between which years the £212.000.000 debt was incurred on the OMBC Housing revenue account, and what was the associated usury attached to the servicing of the alleged debt, as in, what type of interest was negotiated and at what rate and with which bank. This amount can be broken down by each year.

What professional and qualified reasons can OMBC give to its suffering customers that the corporation should ignore and not make any comment or improvements to its housing strategy given the findings and proposals of the 2005 Audit Commission Report on Housing at the time of its issuance.

Since the OMBC continues to operate in debt and service the debt with interest to a bank and the budget for 2010/11 is based on a 1.9% increase in Council Tax to be implemented in April 2011. Why is it that the budgeting management for OMBC still believe that they hold the power to make an increase on council a tax rise to any number they wish and that keeping this tax to a rise of 1.9% is only as a favor to its paying customers. If the Council believe this tax to be lawful, then please could I receive a full and clear explanation as to how you have arrived to this believe.

Please provide the evidence that the Queens Royal Charter that OMBC operate under as a Local Government Corporation is still valid.

. costs of surveys - The 2001 survey was undertaken by Housing Quality Network. The officer responsible at the time was Paul Wrigley

. The 2006 survey was undertaken by Michael Dyson Associates and focussed on private sector housing stock as well as FCHO-managed properties. A 2 % sample survey was undertaken on all the housing stock. The survey cost for this £ 158,354. The officer responsible at the time was Joanne Cavanagh, Private Sector Housing manager.

. The 2008 final survey cost was £ 156,000, although the contract submission was £ 170,400. The survey included a 25% sample survey of FCHO-managed homes, a 10 % sample of garages and 100% survey of shops and tenant halls. The Officer with overall responsibility from the Council was John Rooney, Head of Housing Strategy

Please note any dates the surveys were undertaken may reflect the report completion date and not necessarily the actual dates the survey was taken. The surveys took place over several months. The reports contain the contractors names. The surveys were undertaken by specialist contractors who provided the Council with a legal guarantee that the surveys were undertaken correctly. The specification of the survey would be reflected in the final survey report.

The CPO was not undertaken under health and safety reasons.It was undertaken under the Town and Country Planning Act 1990. The land is not for sale, preferred developers are working up options for new build properties on the various sites

Please could you send the details of the cost of the 2008 refit of
the chief executives personal offices and the Rochdale road
reception area of the OMBC and indicate which "pot" of money was
used to fund this.

The costs of the refurbishment which included work on the Chief Executive's Office, support staff office and the Leader of the Council's office and his support staff was £124,755.70. This was funded through the capital projects fund. The area had not been refurbished since the Council took up accommodation in the buildings more than 30 years ago and included energy efficient lighting and bringing the electrical infrastructure up to date.

The costs of the refurbishment of the Civic Reception area which included the reception area, toilet facilities and the meeting rooms was £653,711.96 and was financed from capital receipts. The area again had not been refurbished in over 30 years. Water ingress had occurred over a period of several years causing water damage to cross walls and saturation of the floor slab. This resulted in damage to plaster work and water collecting in the electric floor boxes. Work also included providing access and facilities within the reception area to ensure compliance with the Disability Discrimination Act. Other work included replacement of ICT infrastructure, PA system, improved acoustics and lighting to include an induction loop for people with hearing problems, as well as providing enhanced security to the building.

The debt that is attributable to the HRA has been incurred over a number of years and includes transferred debt from the reorganisation of local government in 1974. The debt is over a number of loans and these loans are taken with both the Public Works Loan Board and commercial organisations and have interest rates ranging from 3.7% to 11.88%. The debt forms part of the Council's overall treasury management portfolio comprising both General Fund and Housing Revenue Account and although there is an interest charge to the HRA the loans are not taken individually and are not specifically attributable to General Fund or Housing Revenue Account.

This question appears to be more comment than a request for recorded information under the Act, consequently there is no recorded information that answers it. However, the Council produced a Housing Strategy in 2009 which is available to you via the Council website and is therefore exempt under Freedom of Information Act 2000 under Section 21, information reasonably accessible by other means. The delays in response to my last request are expected because your are OMBC a corporation that operates outside legislation . It is usual to for corporate entities to send out apologies and imagine that that would suffice in the hard cold world of commerce and have other people believe that your telling the truth. Why is it that OMBC have accepted that Central government can miracle away “Overhanging Debt” and produce new debt but in the process not take on the “Loan Redemption” which is the profit making of the interest on the loans, and knew this in 2001. but in the same voice state the an RSL must be a not for profit corporate Entity. In 2001 the HRA debt was already at £137 million and incurring Usury to Central government and other Private organisations to the tune of £50 million.

Please send the information that is held at OMBC for the years 2004 to 2010 for the areas of St. Marys and Coldhurst with regard to Crime statistics that would allow appropriate implementation of the Allocations Policy, The Empty Homes Delivery Plans and the void repair and turnover and Best Value Reviews, through multi agency working.Or is this information only exclusive from the statistics of Greater Manchester Police Corporation Oldham East and Oldham west divisions. The high crime rates in these areas reflect the wish of other possible domiciles to live in these areas and has not been brought under any control during these years. Paul Entwistle will recognise the importance of this request since he and I heard the very same questions put to failed ex MP Phil Woolas by Cheri Blairs Matrix Barrister James Laddie QC at his Public High Court Trial in Uppermill and he, as expected, did not receive an honest or clear response. The truth of the crime rates in these areas lies in the common knowledge based in evidential fact of all who live in the areas, and reflects in the repairs bills spend for FCHO in these areas during these years.The High Court Judges neglected to reference this point in their finished Judgment submission statement.

Please supply the information of the dates that were missing from the first four letter sent out by FCHO letting domiciles know that asbestos has been found in Properties in Coldhurst and Failsworth. Please supply the reason as to why the wording in those letters explained that the asbestos was found purely by chance, when in reality it was found in 2005. Please supply the information that was known at that time that the work to remove the asbestos would take 6 days per property. Please supply the information that shows domiciles have the choice not to have the asbestos removed and are not compelled by legislation implemented by force, deceit, fraud and intimidation but can find honorable compliance by known mutual consent.

OMBC Corporation feel that taking harassing and expensive Legal action against Domiciles that do not allow entry to the properties they are paying for, why did they spend £156,000 and request a mere 25% of FCHO housing stock be physically checked and with full knowledge through a desktop exercise of the presence and location of asbestos in all other areas result in a Non intrusive testing exercise that used the subjective words of “Might contain” and “Possible Presence” The Officer with overall responsibility from the Council was John Rooney, Head of Housing Strategy. The company used and paid in this case was Hunters of Manchester during the year 2008, the caveats and limitations handed to this Company in the OMBC brief left the inspectors to report that........ “We have not inspected areas which were unexposed or inaccessible at the time of the survey and consequently we are unable to report that such areas are free from defects. We have not carried out any boroscopic investigation of buildings or any chemical testing of elements to establish the presence of the following,................ Asbestos based materials ..........the results of which may lead to higher repair costs, which are not identified within this report.” It goes on to mention.............. Services, Space Heating – Hot and Cold Water supplies and System........ Elements exist within the survey for surveyors to record defects to the services above. No tests were carried out to establish the safety or quality of water, heating or gas supplies and services. No tests were undertaken to verify the flow of hot water or the efficiency of any boiler or heating appliance within a dwelling.
There is no mention that the contractor Switch2Switch have been repairing these systems for the last 10 years with “no” knowledge of the asbestos contained in their working environment.

Already knowing the outcome of the survey Head of housing transfer Project manager Gerald Davis used the words in 2008 that the survey had achieved and passed the decent homes plus standard meeting the Governments statutory legal obligations and redressing component failure and the Modern standard that was necessary to achieve a sustainable housing quality.

During the same year OMBC found the money to the tune of £778.466 to make the chief executives office more comfortable.
