The CBC monitoring officer has my address for posting as does the clerks Whitehaven town council.

While transfer of this material may be limited by email filters etc, there is no reason why this material cannot be directly published on CBC's website, or if that is an issue due to the recent cyber attack, there are many resources on the web that facilitate this e.g. Google, Youtube, Dropbox etc.

Unless I am misreading your original FOI, your request is for material that is both part of the public record and in the public interest.

It would behove CBC's repeated commitment to "transparency" if they were to release this information into the public domain forthwith.

Jayne, with reference to the above FOI and my previous request for the same information [https://www.whatdotheyknow.com/request/f... ] which was rejected, I would draw both your and CBC's attention to the following:

[1]. The Openness of Local Government Bodies Regulations 2014 specifically states in Part 2 Section 7 that:

"(1) Any person who attends a meeting of a relevant local government body for the purpose of reporting on the meeting may use any communication method, including the internet, to publish, post or otherwise share the results of the person’s reporting activities.

(2) Publication and dissemination may take place at the time of the meeting or occur after the meeting."

This would clearly include any member of the public who chooses to record the proceeds of the meeting (either by electronic or manual means e.g. shorthand).

[2]. ICO guidelines as far as the public interest test state:

"If there is a plausible suspicion of wrongdoing on the part of the public authority, this may create a public interest in disclosure. And even where this is not the case, there is a public interest in releasing information to provide a full picture. Arguments based on the requester’s identity or motives are generally irrelevant. Arguments that the information may be misunderstood if it were released usually carry little weight."

On that basis, I would be grateful if you would publish this information publicly if and when you receive it from CBC. Alternatively, please contact me privately via WDTK as I am keen to discover what is so sensitive that CBC prefers not to have examined in the light of scrutiny .

Thank you for your request for information regarding – Transcription of

I can advise that the information requested has been researched and I am
unable to provide you with the specific information you require.

 

This is because the cost of physical transcription of the information
exceeds the ‘appropriate limit’ as stated in the Freedom of Information
(Fees and Appropriate Limit) Regulations 2004. It is estimated that it
would take in excess of 18 hours to comply with your request.

 

In accordance with the Freedom of Information Act 2000 this email acts as
a Refusal Notice. You have the right of appeal against this decision. If
you wish to appeal please set out in writing your grounds of appeal and
send to the above address. You also have a right to appeal to the
Information Commissioner at the below given address.
