Please provide the following information:

1. Total number, by year, of referrals from registrant chiropodists/podiatrists for alleged misuse of title breaches by unregistered practitioners from 1st April 2004 to 1st April 2016?

2. Total number of prosecutions under Article 39 of the HPO 2001 for misuse of title?

3. Copy of any advisory notes or guidance or correspondence issued to the Society of Chiropodists and Podiatrists relating to the "intent to deceive" element of the Article 39 offences between 1st May 2013 and 1st April 2016.

statistics regarding HCPC fitness to practise hearings.

 

Your request has been handled under the Freedom of Information Act 2000
(FOIA).

 

Please find below our response to your questions.

 

We do not record if the source of the referral is a
chiropodist/podiatrist, only whether they are a HCPC registrant or not. As
such, we have provided the number of cases where the source of the
referral has been classified as either ‘HCPC Registrant’ or ‘Professional’
as detailed in the below table.

There has been one misuse of title prosecution. Of the 949 cases
specifically involving Chiropodists/Podiatrists, 945 have been closed. Of
these, warning letters were sent in 691 cases and cease and desist letters
were sent in 68 cases.

 

Please find attached an article written by the HCPC for the Society of
Chiropodists and Podiatrists’ journal Podiatry Now in December 2015, which
relates to protected titles.
