FT Editorial

Steve Fisher made this Freedom of Information request to Information Commissioner’s Office

The request was successful.

From: Steve Fisher

8 August 2013

Dear Information Commissioner’s Office,

On 5 August 2013, the Financial Times published an editorial
entitled "A law ignored" that was critical of the lack of FOI
enforcement action taken by the Commissioner against the Cabinet
Office
(http://www.ft.com/cms/s/0/a5122378-fb68-...)

On 6 August 2013, the Financial Times published a letter from
Christoper Graham responding to that editorial entitled "A watchdog
not afraid to bark when it needs to"

Please provide me with copies of any information that you may hold
relating to the original editorial or the letter from the
Commissioner sent in response. I expect that this may include
internal/external correspondence as well as traditional media or
social media monitoring reports.

Yours faithfully,

Mr Steven Fisher

8 August.  We are now in a position to respond to your request.

As explained previously, we have processed your request in accordance with
the Freedom of Information Act 2000 (FOIA).

In your email of 8 August you asked us:

‘On 5 August 2013, the Financial Times published an editorial entitled "A

by the Commissioner against the Cabinet Office
([1]http://www.ft.com/cms/s/0/a5122378-fb68-...)
On 6 August 2013, the Financial Times published a letter from Christoper

([2]http://www.ft.com/cms/s/0/65ddfda4-fdf6-...
Please provide me with copies of any information that you may hold
relating to the original editorial or the letter from the Commissioner
sent in response. I expect that this may include internal/external

Please find attached copies of all the information we hold that falls
within the scope of your request. This includes both internal and external
correspondence.

You will note that we are providing extracts of correspondence or
correspondence showing some redaction.

We have redacted personal data from the attached correspondence in
reliance on section 40 (2) FOIA by virtue of section 40 (3) (a) (i). This
exemption enables a public authority to redact personal data relating to
individuals other than the requester where the disclosure would breach a
data protection principle.

To disclose this personal information would breach principle one of the
Data Protection Act 1998 which states that personal data should be
processed fairly and lawfully. We do not consider that it would be fair to
disclose this information in this circumstance.

The extract on page 1 is from an internal email dated 1 August 2013 from
Steve Wood. The remainder is out of scope.

On page 10 of the attached document we have provided an extract of an
email communication from a journalist at the Financial Times to the ICO –
this is the only information we hold about the original editorial.

I hope you find this information helpful.  If, however, you are
dissatisfied with the response you have received and wish to request a
review of our decision or make a complaint about how your request has been
handled you should write to the Information Governance Department at the
address below or email [3][ICO request email]

Your request for internal review should be submitted to us within 40
working days of receipt by you of this response.  Any such request
received after this time will only be considered at the discretion of the
Commissioner.

If having exhausted the review process you are not content that your
request or review has been dealt with correctly, you have a further right
of appeal to this office in our capacity as the statutory complaint
handler under the legislation.  To make such an application, please write
to the First Contact Team, at the address below or visit the ‘Complaints’
section of our website to make a Freedom of Information Act or
Environmental Information Regulations complaint online.

A copy of our review procedure is available [4]here.

Yours sincerely
