My enquiry concerns Article 45 of the Treaty of Rome, associated
Treaties (e.g. Lisbon), Directives and Resolutions (including where
required conversion and incorporation into UK legislation) as
applied to citizen’s of core EU membership (pre-2004) countries ,
countries which acceded in 2004 and those that acceded in 2007. My
questions also focus on the recruitment of overseas trained social
workers.

1. Have your policies and procedures concerning registration been
reviewed and revised in relation to such Treaties, Directives and
Resolutions flowing from Article 45 to reflect transitional
arrangements for citizens of 2004 and 2007 accession countries and,
if so, how and when?
2. What is your policy on equivalence of qualification and
experience when determining salaries and conditions of service for
citizens of such countries?
3. Why and how do you justify having registration fees and procedures that are different for UK trained persons and those trained in other EU countries? Should they not be the same to avoid discrimination on the basis of nationality and ethnicity and ensure compliance with Article 45?
4. This question is specific to future arrangements for social worker registration which falls to become your responsibility later this year. Current General Social Care Council registration costs are 155 pounds for those trained from outside the UK and may have been increased by a further 30 pounds to reflect financial independence had GSCC continued to exist.I understand your scrutiny fee to be 420 pounds. How can you explain to EU trained social workers that to exercise their Treaty rights is going to cost so much more?

An individual who is established in another ‘relevant European State’
(another country within the European Economic Area or Switzerland) in a
profession regulated in the UK by the Health Professions Council (HPC) and
wishes to practise in the UK may apply for registration with HPC, in
accordance with the European Communities (Recognition of Professional
Qualifications) Regulations 2007, which give effect to Directive
2005/36/EC.

The HPC processes were revised when these Regulations took effect and make
no distinction between citizens of accession countries and those of other
relevant European States.

2. What is your policy on equivalence of qualification and experience when
determining salaries and conditions of service for citizens of such
countries?

The HPC has no power to determine salaries and conditions of service for
professionals who are on the Register. Therefore, we do not hold any
information on this issue.

 3. Why and how do you justify having registration fees and procedures
that are different for UK trained persons and those trained in other EU
countries? Should they not be the same to avoid discrimination on the
basis of nationality and ethnicity and ensure compliance with Article 45?

The last consultation took place in 2008. The consultation document and

different registration fees and procedures for applicants who have
qualified outside of the UK.

In response to your questions:

1. Which international organisations were included in the consultation in
2008 relating to HPC’s proposed fees?

No international organisations were included in the consultation in 2008
relating to HPC’s proposed fees. We did not consult with international
organisations on fees as the proposals did not specifically relate to the
international registration process.

However, the consultation was published on the HPC’s website and
publicised in our newsletter and all stakeholders invited to respond.

2. Confirm whether the International Federation of Social Workers and its
members; Colleges/Associations of Social Work established in accordance
with the European Directive; and organisations such as the European
Association of Schools of Social Work have been, or are being, consulted
by the Health Professions Council in relation to the following three
consultations:

- a consultation on the draft standards of proficiency for social workers
in England, which ran from 18 July 2011 to 18 November 2011;

- a consultation on the threshold level of qualification for entry to the
Register for social workers in England, which ran from 18 July 2011 to 18
November 2011; and

- a consultation on the proposed registration cycle for social workers in
England, which ran from 7 December 2011 to 29 February 2012

The organisations mentioned in the question were not contacted
specifically during the consultations. None of the three consultations we
have run recently (standards of proficiency, student fitness to practise
and registration cycle) were directly relevant to the international
registration process. We are always happy to add organisations to our
consultation list and will add these organisations to our list for the
future.

The consultations to which you refer were advertised on our website and in
our newsletter. They were open to the public so that any stakeholder could
reply if they wanted to.

In addition, the General Social Care Council did considerable work to
advertise all three consultations (for example, on their website and in
newsletters).
