Freedom of Information (Scotland) Act 2002 Request

Information Requested

Renfrewshire Council received your request for information on 30 June
2017.  You wrote:

If a Freedom of information request Subject Access Request is sent by
email to Renfrewshire Council Office and enclosed in that email a request
for details to make a payment for that request how should that email be
dealt with both in response and timescale for acknowledgement.

Response:  For the avoidance of doubt, a "Freedom of Information request"
and "Subject Access Request" are two separate requests that fall under
different legislation. The former falls under the Freedom of Information
(Scotland) Act 2002 and the latter comes under the Data Protection Act
1998.

The Council details how requests can be made on dedicated pages on its
website. They located at the following links:

Whilst there is no statutory provision to acknowledge requests, it is
certainly best practice to do so as soon as possible. Responses to FOI
requests must be sent no later than the 20th working day following receipt
and Subject Access Request response must be sent no later than the 40th
calendar day following receipt.

Council staff are provided training and guidance to recognise requests in
order to forward them to the appropriate team for processing, but the
Council encourages members of the public to submit requests directly to
our dedicate mailbox at: [Renfrewshire Council request email]

Review Procedure

If you are dissatisfied with the way in which the Council has dealt with
your request, you are entitled to require the Council to review its
decision.  A copy of the Council’s review procedures is detailed in the
attachment below.
