1. Can you please provide updated compliance figures for FOI requests for 2020-21?

I can see there are some published figures https://www.whatdotheyknow.com/request/c... but these show open requests at the point the response was issued.

2. Please also provide the same figures for FOI requests for 2021-22 and 2022-23 financial years.

3. Please also disclose information held about the following statement made in response to that request:

“The publication of the performance data set out within the Code is recommended best practice and not a legal requirement. However, CQC’s
Information Governance Group will be reviewing this guidance in the next few months and considering our position on future publication. CQC’s Information Rights Manager will write to you to advise you of the outcome of that discussion.”

Please include a copy of the reply to the applicant and any record of the decision made regarding publication.

I have not been able to find published figures on your website.

I write in response to your Freedom of Information Act 2000 (FOIA) request made to the Care Quality Commission (CQC) on 11 July 2023

You requested the following information:

1. Can you please provide updated compliance figures for FOI requests for 2020-21?

I attach a document holding corresponding data on FOIA, GDPR Subject Access Requests (GDPR SAR), Environmental Information Regulations (EIR) requests and information sharing requests from other public bodies handled by CQC in the years 2020-21, 2021-22 and 2022-23. Included in the spreadsheet are the number of each type of requests showing as open on the CQC Information Access Team database at the end of each reporting year (i.e. on 1 April of the next reporting year).

The compliance figures are calculated for the reporting year in which requests are responded to, not for the year in which they were received. Therefore the year end figures for 2020-21 are the same as previously reported. I can advise you that - as of today's date - no requests from 2020-21 remain open. 1 FOIA and 1 SAR from 2021-22 remain open (these requests are linked to each other). 2 FOIA requests from 2022-23 are still open.

CQC does not hold the requested information for part 3 of your request. The original request to which you refer was handled at a time when CQC was under considerable pressure during the Covid-19 pandemic and it appears that the anticipated review of our position on publication of performance data was not completed.
