from 1st Jan 2005 to present day, and broken down annually.

2. Out of these, the number that received a response within the
20-working day limit.

3. The longest time taken to respond to a request.

5. Out of those requests that were refused, please provide, in
accordance with section 17 of the Act, the specific exemption in
question.

I do not need this for each individual case, but a tally of how
many cases were refused for specific exemptions.

eg.

135 cases refused by virtue of section 30 (2) FOI Act 2000.

59 cases refused by virtue of section 40 (1) FOI Act 2000.etc.

6. The number of requests subject to an internal review.

7. The results of any internal requests. i.e did the authority
uphold the original decision?

8. The number of cases referred to the Information Commissioner

9. If any such cases exist, details of the cases. i.e. date,
subject of the request, reason for exemption, what the result was.

10. The criteria used when considering the public interest test.

requests, I write to ask for clarification of some aspects of your
request.

Where you have asked for details of requests refused in accordance with
section 17 and the associated exemptions, can you please confirm whether
partial refusals are to be included in this response.

i.e. where in a response part of the information requested has been
refused by virtue of section 43(2) or section 40 but perhaps a large
portion of the information was supplied.

The Freedom of information Act 2000 allows the council 20 working days
in which to respond to information requests. However, the "clock" stops
when we need to seek clarification in order to locate or identify
relevant information. Once we have received the requested
clarification, I will proceed with your request.

Dear Mr Plough,

Further to your request for information about requests made under the
Freedom of Information Act, please see the attached spreadsheet and note
the following additional comments.

1. The figures provided are for the calendar year for 2005, January
2006 to March 2007(15^th Months) and then annually by financial year from
there onward. The council does hold figures for all the calendar years
requested, however as the council's annual reports relate to financial
years from 2007 onwards this was the most reasonable way to provide the
information to you.

2. Please see the attached spreadsheet, worksheet 1 - overview. Please
note that there are a range of reasons why the council has been unable to
meet the 20 working day timescale, these will include, particularly
complex requests and the ever increasing volume of requests being
received. You are also advised that the recording and reporting systems
previously used did not allow for response times to be accurately tracked
where there was a need to seek clarification from the requestor and or the
application of Section 17(2)(b). We can now confirm that recent
developments to our systems have improved our reporting facilities in this
regard.

3. This information has not been disclosed in line with the above
constraints and subject to Section 12 of the Act, as the time required to
elicit this information for the periods requested would exceed the
appropriate time limit provided for under the Act .

4. Again the council does not record the information requested in a
form that allows this information to be elicited within the appropriate
time limit. Where exemptions have applied these are recorded as detailed
in Question 5. However as the exemptions may have been applied either
partially or wholly to a request, we are unable to confirm a figure in
response to this question subject to Section 12 of the Act.
