Freedom of Information request - Direct Engagement of Locum Staff using third parties

I am writing to request information under the Freedom of Information Act 2000. I would be interested in any information held by your organisation regarding my request. I understand that I do not have to specify particular files or documents and it is the departments responsibility to provide the information I require. If you need further clarification please contact me via this website (or email). I would like to request the following information:

1. Does your organization use a Direct Engagement scheme?
2. If so, who provides it? And when did you start using it?
3. Did you take external legal advice before entering into it and, if so, from whom did you take external legal advice?
4. What has your total locum/temporary staffing spend since you started using the scheme? If you started using the scheme before April 2017 please also state the total locum/temporary staffing spend since April 2017.
5. How does the third party direct engagement facilitator save you money on the agency spend? Please answer in short point form
6. How much has been paid to the third party direct engagement facilitator thus far?
7. Was this payment calculated as a percentage of the savings generated by employing the services of the third party direct engagement facilitator? If so, what percentage is this?

I would like the information to be provided by email or on this website in electronic form. If my request is denied in whole or in part I ask that you justify all deletions by reference to specific exemptions of the act. I will also expect you to release all non-exempt material. 3. Did you take external legal advice before entering into it and, if so, from whom did you take external legal advice? Procured via Crown Commercial Service G-Cloud Contract. Information re contract available upon request.
4. What has your total locum/temporary staffing spend since you started using the scheme? If you started using the scheme before April 2017 please also state the total locum/temporary staffing spend since April 2017.
5. How does the third party direct engagement facilitator save you money on the agency spend? Please answer in short point form Supply chain efficiencies and reduced administration via one model of supply. Transparency of pay and agency charge rates.
6. How much has been paid to the third party direct engagement facilitator thus far?
7. Was this payment calculated as a percentage of the savings generated by employing the services of the third party direct engagement facilitator? If so, what percentage is this? No; charged as set fee per hour.

I am writing to request an internal review of Derby Teaching Hospitals NHS Foundation Trust's handling of my FOI request 'Freedom of Information request - Direct Engagement of Locum Staff using third parties'.

--------PLEASE NOTE THAT THERE IS ALSO AN ADDITIONAL FOI REQUEST AT THE END OF THIS MESSAGE------
I would specifically like clarification around two answers which may be potentially not be quite what was asked.

1) The question on legal advice has not been answered. The trust has stated how it procured the service, i.e. via G-cloud Crown Commercial service. The implication which the trust seems to be making here is that it took no due diligence itself as it assumed another party undertook it. Please could you explicitly answer the question asked: Did the trust, or did the trust not take specific legal advice, from one or more regulated legal professionals, with respect to this service?

2) With respect to the question on how this scheme saves the trust money, it has failed to explain the implications upon its tax position - specifically with reference to Value Added Tax (VAT). This aspect of this specific scheme has been well publicised - indeed Dame Margaret Hodge MP has previously remarked upon it on the record after being shown the promotional video from this scheme promotor. Could you please confirm that, as a result of this scheme you do not pay VAT when engaging temporary via agencies?

Under the Freedom of Information Act 2000 please disclose:
1) The risk assessments and minutes of the meetings discussing this model and the one at which it was decided to adopt the Direct Engagement model.
2) Any advice you may have received suggesting you to adopt a direct engagement model prior to its adoption.
