Freedom of Information request compliance
Dear University of Durham,
I would like to know, during each of the calendar years 2019, 2020, 2021, 2022, and 2023 (to date)
(i) On how many occasions has the University of Durham failed to respond to a Freedom of Information Act request within the statutory 20 working day time limit required by law.
(ii) On how many occasions, when an internal review has been requested, has the University of Durham failed to conduct an internal review and notify the requesting party of the outcome of the internal review within the 20 working day timeframe mentioned in the ICO Code of Practice.
I would like each of (i) and (ii) as an absolute number e.g. 4, and a percentage e.g. 10% of requests received.

Thank you for your request for information from Durham University.
Colleagues have provided the information below/attached in response to
your questions.
I would like to know, during each of the calendar years 2019, 2020, 2021,
2022, and 2023 (to date)
(i) On how many occasions has the University of Durham failed
to respond to a Freedom of Information Act request within the statutory 20
working day time limit required by law.
(ii) On how many occasions, when an internal review has been
requested, has the University of Durham failed to conduct an internal
review and notify the requesting party of the outcome of the internal
review within the 20 working day timeframe mentioned in the ICO Code of
Practice.
I would like each of (i) and (ii) as an absolute number e.g. 4, and a
percentage e.g. 10% of requests received.
It is estimated that the time taken to locate, retrieve and extract the
requested information would exceed the fees limit associated with the
Freedom of Information Act 2000 (FOIA). Under Section 12 of the FOIA, the
University is not obliged to comply with a request for information if the
cost of compliance would exceed a £450 threshold, a figure which equates
to approximately 18 hours of work spent searching/retrieving and
extracting requested information.
As the final question would have taken the total amount of time required
to provide the information over the appropriate limit, as a gesture of
goodwill, provided below is the information in answer to the first three
questions of your request.
Please note the below table does not include Freedom of Information
Requests where extra time has been required to consider the Public
Interest Test and this has been communicated to the requester within 20
working days of the request being submitted as per Section 10(3) of the
Freedom of Information Act.
