I refer to your request for an internal review of your recent
Environmental Information Regulations request.

Your review request stated:

I am writing to request an internal review of Leeds City Council's
handling of my FOI request 'Freedom of Information Request: Byelaws and
Policies on Recreational Use of Drones'. Our request is now significantly
overdue.

Having looked in to this matter I am aware that you submitted a request
through whatdotheyknow.com on 7 March 2024. This asked:

We are writing to make an information request under the Freedom of
Information Act 2000. We seek information regarding your authority's
regulations on the recreational use of drones from land under your
jurisdiction.

1. Do you have any byelaws specifically relating to the recreational use
of drones from your land? If yes, please provide:
a) The date(s) of these byelaws.
b) A digital copy of the byelaw(s) or a link to where these can be found
on your website.

2. In the absence of specific byelaws, do you have any policies relating
to the recreational use of drones from your land? If yes, please provide:

You then emailed chasing this request on 17 April 2024, whereupon you were
advised that the Council had no record of receiving it and that you
should, consequently, re-submit this (this was necessary as the Council
did not have a record of your request on our system, so we could not
process it until this was received).Β 

You responded resubmitting your request on 18 April after which, on 7 May,
you submitted this appeal as you believed the request to be overdue.Β To
note, however, as the Council did not receive a copy of your request until
18 April, we are required to consider the legal due date for your request
as 16 May.

I do appreciate that this delay may be disappointing, however I would like
to assure you that your request is under active consideration and that the
Council will respond at its earliest convenience. I have, unfortunately,
been unable to ascertain as to why the Council does not hold a record of
this request, but this may well be due to an error with Whatdotheyknow.com
(which is an independent third-party website) failing to send your request
on successfully.

This concludes my response to your appeal. If you remain dissatisfied with
the response of the council under Regulation 18, you are entitled to apply
to the Information Commissioner for a decision as to whether, in any
specified respect, your request has not been dealt with in accordance with
parts 2 and 3 of the Regulations.

Part 6 paragraph 37 and 38 are the rules and mean that drones can only be
used in our Middleton Park, subject to restrictions

If the flight is a one off "performance" it is possible to apply for a
consent license to allow the flight, but that is at the council's
discretion

I trust that this response is satisfactory. Under Regulation 11, however,
you are entitled to make representations to us if it appears that we have
failed to comply with a requirement of the Regulations in relation to your
request. Representations must be made to us no later than 40 working days
after the date you believe we failed to comply with such a requirement.Β 

We will then consider your representations and supporting evidence and
decide if we have complied, notifying you of our decision as soon as
possible, and no later than 40 working days after the date of receipt of
your representations.Β 

Under Regulation 18, you are then entitled to apply to the Information
Commissioner for a decision as to whether, in any specified respect, your
request has not been dealt with in accordance with parts 2 and 3 of the
Regulations.Β
