My name is Sarah Wilson and I am using a WhatDoTheyKnowAccount shared with my colleagues Harriet Clugston and Claire Wilde. I am writing to you under the Freedom of Information Act 2000 to request the following information from you:

I would like you to provide me with the number of people arrested by the force during their participation in a protest from the beginning (01/01/20) of 2020 up to 31/05/21 broken down by month. For each person arrested, I would like you to provide me with the protest type (e.g. Black Lives Matter, 5G, pro-life) attended, the person’s age, sex and ethnicity, and the power under which they were arrested.

In addition to this, I would like you to provide me with the outcome of each person’s arrest: e.g. a fine, a charge.

I would appreciate the information in spreadsheet format if possible. If there is any way in which you would like me to refine or explain my request further, please let me know.

and the power under which they were arrested.  In addition to this, I
would like you to provide me with the outcome of each person’s arrest:
e.g. a fine, a charge.

            

Response:

Please be advised that information regarding arrests, cautions and fines
in association with protests is not held centrally and is not available in
a readily retrievable format. Due to the way information is recorded, in
order to provide a response to, it would be necessary to manually review
all arrests, cautions and fines made by Warwickshire Police to determine
whether they were connected with an event. This would not only be in
relation to specific dates of an event protest/march, but through 2020 and
up to the date of your request as cautions and fines would not necessarily
be issued immediately. As an example of the numbers involved, just looking
at arrests alone; Warwickshire Police record around 500 to 600 per month.
Therefore, the work involved in determining the information in relation to
the outcome of your request exceeds the amount to which we are legally
required to respond i.e. the cost of locating and retrieving the
information exceeds the ‘appropriate level’ as stated in the Freedom of
Information (Fees and Appropriate Limit) Regulations 2004.

 

In accordance with the Freedom of Information Act 2000, this letter acts
as a Refusal Notice for this part of the request and, if one part of a
request exceeds the fees limit, then S12 of the Act applies to the whole
request.

 

In accordance with Section 16 of the Act I have a duty to provide advice
and assistance in relation to your request, however due to the volume of
records that would need to be reviewed I have been unable to identify
information that could be supplied within the fees limit in relation to
this element of your request.

 

Every effort has been made to ensure that the information provided is as
accurate as possible.

 

Your attention is drawn to the below which details your right of
complaint.
