I refer to your request dated 19 February 2024 under the Freedom of
Information Act asking to supply the following information:

The details we require are:
1 - What are the contractual performance KPI's for this contract?

Response – Please see attached.

2 - Current annual volume in tonnes?

Response – Circa 40,000 tonnes

3 - How the material is presented?

Response – Comingled

4 - Suppliers who applied for inclusion on each framework/contract and
were successful & not successful at the PQQ & ITT stages

Response – The Council holds this information and is disclosing the name
of the supplier who applied for inclusion on the contract who was
successful at the ITT stage as follows.

 

The successful bidder following ITT was Associated Waste Management Ltd.

 

However, the Council is withholding the names of suppliers who applied for
inclusion on each framework/contract and were not successful at the (PQQ
&) ITT stages under Section 43(2) of the Freedom of Information Act 2000,
which allows public bodies to withhold information which is likely to
prejudice the Council’s or third parties’ commercial interests. The
tenders were established through a competitive tendering process and the
Council considers disclosure of the names of the suppliers who were
not successful would be likely to adversely affect these third parties’
positions in a competitive business environment.  It is likely that
unsuccessful bidders would suffer reputational damage if the information
was disclosed to the public at large and their competitive position in
their respective market would be adversely affected. In conjunction with
media reporting, customer and investor confidence in their operations
could decline.

 

I have considered the public interest in disclosing information in
response to this request, which includes the fact that this would aid
openness and transparency. However, although there is a public interest in
facilitating accountability and transparency in how public contracts are
awarded and public funds are spent generally, there is an overriding
public interest in ensuring that commercial and financial interests of
third party suppliers are not disclosed to competitors, as disclosure of
their names as unsuccessful bidders into the public domain in conjunction
with other information already available could materially prejudice the
third parties’ commercial and financial interests. The Council takes the
view that there is an inherent public interest in the maintenance of the
exemption, and of generally upholding third parties’ expectations that
this commercially sensitive information will be protected from disclosure
when they engage in public authority tenders thereby avoiding reputational
damage.  The Council does not view it is in the public interest to
discourage prospective tenderers from tendering for its public sector
contracts, for fear of disclosure of their commercially sensitive
information to competitors. If it were to do so, the Council has concerns
that this would adversely affect both the quality of tenders for its
contracts, and the Council’s ability to negotiate them effectively. The
Council believes that it is important to maintain a competitive market and
keep driving competition as this benefits both public authorities and
consumers and this could be adversely affected by disclosure of the
providers’ commercial information. If this information is disclosed it is
likely to undermine the Council’s relationships with its third party
providers and risk a shortage of providers in the district and ultimately
drive up costs. This would have a detrimental impact on the public purse
which would not be in the public interest. Also general information on the
successful suppliers is being disclosed and has been published in the
public domain.  Having weighed the opposing public interest arguments I
have concluded that the public interest in maintaining the exemption
outweighs the public interest in disclosing the information.
