I would be most grateful if you would provide me, under the Freedom of Information Act, details in respect to the link below.

• What are the contractual performance KPI's for this contract?
• Current annual volume in tonnes?
• How the material is presented?
• Suppliers who applied for inclusion on each framework/contract and were successful & not successful at the PQQ & ITT stages
• Actual spend on this contract/framework (and any sub lots), from the start of the contract to the current date
• Start date & duration of framework/contract?
• Could you please provide a copy of the service/product specification given to all bidders for when this contract was last advertised?
• Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension?
• Has a decision been made yet on whether the framework(s)/contract(s) are being either extended or renewed?
• Who is the senior officer (outside of procurement) responsible for this contract?

The Council’s response to your specific questions is set out below:

The details we require are:
• What are the contractual performance KPI's for this contract? Due
to the age of the contract, there are no performance KPIs .
• Current annual volume in tonnes?
All Kirklees Council waste arisings and destinations (including the
country, for any non-UK destinations) are reported to the government on a
quarterly basis – it is publicly available and can be accessed by going to
[2]https://www.wastedataflow.org/ and creating an account.
Users need to register for an account and then go to Summary Reports and
then apply the filters for the data that they wish to view.
To get the full level of detail, ‘Raw Data’ must be selected as the Report
Type and ‘Quarterly’ as the Period Type.
A region must be selected in the drop-down menu under the ‘Select
Authority’ filters. Any Local Authorities for which data is not required
will need to be removed from the list before running the report. Periods
and questions must also be moved into the ‘Selected’ lists before the
report is run.
As this is an external system, any further queries should be directed to
WasteDataFlow themselves.

As this contract was signed/commenced in 1998, the tendering process was
carried out in 1997 and the Council only hold paper records with limited
information.
The following suppliers bid on the contract:
United Waste Limited (successful in securing the contract)
Yorkshire Environment Limited (unsuccessful)
Martin Engineering Systems Limited (unsuccessful)
Northumbrian Environmental Management Limited (unsuccessful)
VEDCO Energy Limited (unsuccessful)
• Actual spend on this contract/framework (and any sub lots), from
the start of the contract to the current date
Specific contract spend is commercially sensitive as it includes data
supplied by a third party contractor and would impact on the Council’s
ability to negotiate competitive pricing in the future, therefore we are
refusing to provide this information under s43 of the FoI act. Please see
the attached refusal notice for more information
However, publicly available information on revenue outturn for waste
disposal and recycling can be found annually for each local authority in
England on the government statistics website. For example, information for
the financial year 2022-23 is available here:

• Start date & duration of framework/contract? Start date
02/04/1998, duration 25 years with the option for a 5 year extension in
yearly increments.
• Could you please provide a copy of the service/product
specification given to all bidders for when this contract was last
advertised?
Due to the age and complexity of this contract, the tender pack /
specification consists of approximately 4 lever arch files of paper
documents which have been archived. There is no digital version to share.
To scan all of the paper documents within these files would exceed the 18
hour limit.
If there is a specific element of the specification that is of interest,
we could consider to scan and create electronic copies of this.
• Is there an extension clause in the framework(s)/contract(s) and,
if so, the duration of the extension? Yes, the contract has a clause
option for a 5 year extension in yearly increments.
• Has a decision been made yet on whether the
framework(s)/contract(s) are being either extended or renewed? The
contract has been extended for two years, to 01/04/2025.
• Who is the senior officer (outside of procurement) responsible for
this contract? Will Acornley, Head of Operational Services.
