Dear Mr Macleod
Freedom of Information (Scotland) Act 2002 - Partial Release of
Information
Subject: Free Masonry
Thank you for your request for information which has been dealt with under
the terms of the Freedom of Information (Scotland) Act 2002.
Unfortunately, the Council is able to meet only part of your request; this
information is released to you now in the format requested.
Your request:
"I note that the Lord Provost attended an International Conference on Free
Masonry.
Please advise whether he is a mason and therefore ought to have declared
this interest."
The Council does not hold this information in a recorded format. Please
note that this letter constitutes a formal refusal notice under Section 17
of the Freedom of Information (Scotland) Act 2002.
Although this information is not recorded, the Lord Provost has confirmed
that he is not a mason.
You then asked:
"Please provide e-mail correspondence from the Lord Provost in respect of
his attendance, garnering support and approval to attend this forum."
The attached Committee Reports and Minutes demonstrate the approval
process for the attendance of the Lord Provost at the International
Conference on the History of Freemasonry on 24-26 May 2013. These
Committee Reports and Minutes are available to view on our website:
[2]www.edinburgh.gov.uk/cpol
Despite formal approval, the Lord Provost did not actually attend the
conference as a delegate due to other commitments. However, in line with
his civic duties, the Lord Provost did present the opening speech at the
conference as representative of the City of Edinburgh, the host city.
Please find attached correspondence detailing this course of events.
Information within this correspondence is being withheld. Under the terms
of the Act, a request for information can be refused where one or more
exemptions listed in the legislation apply. In this instance, the Council
is applying the following exemption to the information that you have
requested: Section 38(2) - Personal Data.
Personal data means data which relate to a living individual who can be
identified from those data. We consider that the release of this
information would breach the first data protection principle, that of fair
processing, as it would not be fair, or expected, for the personal data of
these individuals to be released into the public domain.
Please note that this letter constitutes a formal refusal notice related
to this part of your request under section 16 of the Freedom of
Information (Scotland) Act 2002.
To promote transparency and accountability, please note it is the
Council’s policy to publish all request details and responses made under
freedom of information legislation. This information will be made
available through the Council’s website and will not include your personal
details.

I appreciate that our decision may disappoint you and I am sorry that we
have not been able to release all the information you requested on this
occasion. If you are unhappy with the way we have dealt with your request,
you can ask us to review our actions and decisions by writing to the Head
of Legal Risk and Compliance, The City of Edinburgh Council, Waverley
Court Business Centre 2:1, 4, East Market Street, Edinburgh, EH8 8BG or
