Wirral Council currently has a framework agreement with SCC (Specialist Computer Centres) plc.

This request is for that framework agreement and a copy of the following invoices.

Good Afternoon,

Thank you for your email below, apologies for the slight delay in
responding. Please see a copy of the Framework Agreement with SCC plc
attached.

 

In relation to the invoices which you have requested, the Council is
unable to disclose these to you and has relied on the exemption contained
within section 22 (1) Information intended for Future Publication.  Please
see more clarification on the use of this exemption below:-

 

This month, The Department for Communities and Local Government has issued
its Local Government Transparency Code 2014.  This Code requires Local
Authorities to proactively and routinely publish some data; to publish
some data on an annual basis and also gives recommendations for some
additional data to be published.  Local Authorities have a 6 month period
from May 2014 to comply with the code.

One of the types of Information which must be published is Invoices.  The
Council will therefore be proactively and routinely publishing invoices
within the next six months, in accordance with the code.  Your request for
the invoices is therefore refused and we have relied on the exemption
contained within Section 22 (1) of The Freedom of Information Act 2000.
  The exemption does not require for the publication date to be determined
but in any case it will be within the next 6 months.

 

You have the right to ask for an Internal Review of the refusal to supply
some of the information requested and this should be addressed to
[2][Wirral Borough Council request email] and it will be assigned to an
Officer.  If you remain dissatisfied with the result of any Internal
Review then you may complain to the Information Commissioner at

You refused the request for the invoices on the exemption contained within s.22 and provided me with a copy of the customer guidance notes for the Sprint II Framework agreement (and stated that these customer guidance notes were the framework agreement).

Although the customer guidance notes referred to the framework agreement, they were not the framework agreement, therefore I would like you to supply me with the actual framework agreement rather than the notes for it.

On the subject of the invoices, you are right that a Local Government Transparency Code was published in May 2014. The invoices requested cover the period November 2013 to February 2014. Apologies that my original request stated "November 2014" when it should be "November 2013" and "December 2014" when it should be "December 2013".

I have read the Local Government Transparency Code 2014 and it does require you to publish invoices for expenditure over £500. However the Local Government Transparency Code 2014 does not require invoices created before the Local Government Transparency Code 2014 was published to be published.

Therefore there is no requirement on Wirral Council due to the Local Government Transparency Code 2014 to publish past invoices prior to the Local Government Transparency Code 2014 being published.

I therefore request an internal review of the invoices side of this request on the grounds that the Local Government Transparency Code 2014 does not place a requirement on Wirral council to publish the invoices that this FOI request is about, but only invoices created after the Local Government Transparency Code 2014 was published. Therefore the exemption in s.22 would seem not to have been applied correctly.

Dear Mr. Brace,
This email is Council’s response to your request for an Internal Review.
In regard to the framework agreement document, I can confirm that the document previously sent to you containing notes for the framework agreement is the only recorded information that Wirral Borough Council holds. I apologise that this was not made clear to you in our initial response.
The actual framework agreement document itself is held by Crown Commercial Services who can be contacted via their website at this link. The Council does not have a copy of the agreement to provide to you.
In regard to the supply of invoices, it is the Council’s intention to publish these invoices in line with the Local Government Transparency Code 2014 and we believe we can rely on the exemption contained within section 22 of the legislation. There is nothing in the code that prohibits the publishing of invoices form an earlier date.
In addition to this, the accounts of the Council are available for inspection once a year and invoices such as those requested would be available to be inspected. Therefore the Council can also place reliance on Section 21 of the Freedom of Information Act 2000.
